My fiancee and i got married, two weeks ago. We got our marriage license last week. We try to get her a texas Drivers learning permit. When we went to the DMV. The lady said that she is not eligible on the basis that the I-94 must be valid for a year. Since her I-94 is valid for 90 days, we must wait for her to get a green card before she can even apply for license. Is that true?? or is there a way we can go around this?? We applied for her SSN, it went well.

That is the way it is in CA. with the exception of EAD. In CA when you get EAD, it is proof enough for a Drivers License.

That is the way it is in CA. with the exception of EAD. In CA when you get EAD, it is proof enough for a Drivers License.

I am from Houston, and they only ask for my SS form. I dont actually have the ID itself, so I presented the paper which SS Office issued to me. I guess you may want to try after you got your SSN.

We had no problems at DMV. However, we got an ID first (because he didn't know about the regulations for driving at the time) and went back later for his DL, using his Texas ID instead of his I-94. There is nothing on the Texas DMV website that says the I-94 has to be good for a year. However, nothing on the website that someone with a K-1 visa has was listed as acceptable proof either. There is a stipulation on there that says "or other forms of ID that are up to the discretion of the office." I would try either A. going and getting an ID first, or B. just trying at a different office and see if they have a different set of procedures. Also, look at the TXDPS website for the list of acceptable forms of ID.

Just so you know, a person DOES need a SSN for a license, so you'll have to be able to provide them with proof of the actual number. Not sure if it's the same for a permit.

An I 94 is ALWAYS only valid for 90 days, never for a year (correct me if I'm wrong). I've never heard of a tourist with a one year I94W or someone entering on a K1 with a one year I94. What might have happened is that the I94 is close to its expiration date, in that case (usually about two weeks before it expires) they request the EAD or Greencard. Same counts for the Social Security Card.

Removal of Conditions Timeline:

03/19/2008 - package sent to TSC, let's hope for the best

03/20/2008 - check cashed

03/26/2008 - case sent to Vermont Service Center

04/17/2008 - Biometrics scheduled

05/19/2008 - received I551 extension stamp via INFOPASS

02/12/2009 - APPROVED

02/21/2009 - GC received...no mistakes...valid until 2019

I also Live in San Antonio...When you went for your ID, did you use the passport and I-94??
