I-864 IRS jointly with ex-husband

Hello,

My wives most recent tax return transcript is fine as it was only her income on it. But the ones from the two previous years, she was married filing jointly with her ex-husband. I didn't know the transcripts wouldn't show separate income (neither does the tax return itself). And she can't seem to find the W-2. Her ex says he doesn't have them but she can't find them where they were and all their old tax stuff isn't there...so yeah.

We are only sending in her most recent transcript (and we are using a joint sponsor which has the 3 years fine), but what should we put in the fields for the 2 other years? Do we put the amount listed on the transcript (that is for them both) or do we really need to find the W-2 and put just her income?

2015-10-11: Resubmit via EP after being told to do so on 2015-10-09 as it looked like our original emails were lost

2015-10-16: Received email for scan date of 2015-10-12. Told that basically nothing can be done and we need to wait 30 days from 2015-10-12 (30+ days lost because they lost our emails)

2015-10-26: Told case is basically complete but that they are building my electronic file. Told there is no timeline for this.

2015-10-30 & 2015-11-13: Still told no update. Building electronic file still and no timeline.

2015-11-17: Case Complete

2015-12-03: Receive packet 4

2015-12-15: Medical

2015-12-18: Medical picked up results

2016-01-12: Interview - Approved!

2016-02-03: POE

Timeline

This is not a problem at all. Your wife can easily call IRS at 1-800-829-1040 and ask for this information verbally. They can provide the details of Wage & Income reported solely to her, under her SSN.

Also, this is known as a Wage & Income Transcript that can also be ordered for a hardcopy to be mailed to her for backup and just in case she's asked to provide the document in the future.

I would suggest just calling in and asking for the info. Once she's provided the info ask for the Wage & Income transcript to be mailed. I would also suggest calling early morning, before 9am, or late afternoon, after 5pm. Hold times are pretty long right now last I checked.

She must put exactly the number it says on the Total Income line on her tax returns for those years, regardless of how she filed.

I don't think they have this info. They used TurboTax and I have seen the electronic version of the return and it just has one line for income. And since it was electronic they never sent in the W-2 so I think they would only know based on W-2.

So even if it is a joint return and not all of it is her income I should put the total income line?

IRS has all this info and then some. Trust me - I'm a registered tax preparer in California. Your wife can call at anytime and ask for her wages and income for a particular year and they would provide this verbally. (W-2 information is passed on to the IRS by the employers whenever any W-2, 1099 or any other income is reported - so it's in their computer systems on an individual basis no matter what.)

But as to the part about if you should list her individual income or her joint income - that I wouldn't know. But like I said, if you want her individual info then have her call in for it verbally and then have her ask for the Wage & Income transcript to be mailed.
