Hi,

I have to resubmitt my i-864's. It's super confusing but I think I almost get it.

I have 2 questions.

1. My joint sponsor is married. Does their spouse HAVE TO submit the i-864a?

2. Do they require income to be at 125% of the poverty line in PART 6: line 19a AND 19b AND 19c of will it be sufficient if the most recent tax return in 19a meets the guidelines?

I believe if they all need to meet the guidelines but don't that we can also state other assests in that case.

1. No, the spouse doesn't have to unless their income is being used to meet the 125% poverty guideline. In this case, you'll need to submit employment letter, W-2s, and pay stubs in order to show sponsor's income as differentiated from the spouse's if on their tax returns they're filing jointly.

2. I don't think any of these need to meet the poverty guidelines. What they're really going to look at is Part 6: Q15. The tax returns just help show that the sponsor has a consistent income.
