The journey is stressful & can be financially draining, however medicals & police

records run out 6-12 mths depending on embassy, many ppl have had to struggle

thru the system for yrs at times, but migrating to the USA is a privilege & not a

right regardless who one may have here.....backlogs, petitions from all over the

world & background checks for all these millions of ppl clog the system...I understand

your frustration but a lawsuit on USCIS,,,phew !...hope you hear something soon

I'd appreciate some help with my I-485 case, which has been going on since April 24, 2014.
After filling all of the information and a 9 month delay, USCIS replied that my medical exam was expired, though it obviously expired because of the 9 months.
After sending in my medical exam, now they claim that my fingerprints are expired (How does that even happen?) and are further delaying the case.
It has been 1 year and 5 months, which is 4 times as much compared to regular processing times. It has also cost me additional money to get the required documents.
What are my chances of winning a lawsuit and what would I actually win? There is no point of spending more money just to receive my green card, but if I manage to at least get my money back, I'm willing to do it.

Once you get the new appointment for your biometrics please go and get it done.

Forget about the lawsuit.

06/29/2015 - fingerprint fee accepted.
06/30/2015 - Received text & e-confirmation of NOA. Case received & routed to USCIS National Benefits Center
07/06/2015 - NOA1 received.

07/13/2015 - Biometric letter arrived mail box. Date 07/24/2015

07/24/2015 - Biometric done. One month mark

08/29/2015 - EAD approved

09/03/2015 - EAD card mailed

09/04/2015 - EAD approval mail in mail box

09/08/2015 - EAD card received.

09/09/2015 - Applied for SSN.

09/15/2015 - Got my SSN in the mail

04/14/2015 - Update online: Your interview has been scheduled for 05/19

I know your frustration! We got a NPIW in September of last year. We got an RFE June of this year for expired medical. We complied with that, then got a notice of an interview. We just completed that on Tuesday, and was approved.

We filed a case with ombudsman, and with our senator. It was through our senator that we found out we were waiting to be scheduled for an interview.

Suing USCIS is a lose-lose situation. Your best bet is to contact your senator or congressman, and file with ombudsman.

 

8/22/15 Received notice of interview "call in letter" for September 1st 8am

9/01/15 AOS Interview Houston-APPROVED!

9/01/15 Card in production, Welcome notice has been mailed

9/05/15 Welcome Notice Received

9/08/15 Greencard was mailed

9/10/15 GREENCARD RECEIVED!!!!!!!!

6/2/17 mailed I-751 to csc priority mail

7/1/17 I-751 returned rejected (multiple items)

7/3/17 I-751 mailed again with signature confirmation

7/6/17 second I-751 delivered and signed for by Daniel Manchaca

7/10/17  Check Cashed

7/10/17  NOA

7/22/17  Biometrics letter for 8/2/17

8/02/17 Biometrics appointment DONE

3/05/18 case moved to local office

8/25/18 Extension letter (18 months)

9/29/18 service request submitted

10/06/18 response to service request

10/11/18  approved. No RFE, no interview

10/16/18  approval letter received in the mail

10/19/18 greencard received

At the interview, the IO said that I've been approved for the permanent resident card and I will receive the GC by mail within 10-14 days!
Nothing so far!

Receive a paper at the interview or in the mail stating you were approved? Status online ever change?

What have you done to check on the delay of your green card? Contacted them? Infopass? Congressperson? USCIS Ombudsman?

The worst thing is that I discovered this forum after the interview.
At the end of the interview, the IO didn't give us a paper and we didn't know about that famous paper.
She just told us verbally that I am approved for the Permanent Resident Card and that I will receive the card by mail within 14 days.

The online status is saying the same thing like before the interview:
"Interview Is Scheduled On September XX, 2014, we scheduled you for your interview and mailed you an interview notice for Receipt Number MSCXXXXXXX.

Your interview is on October XX, 2014. Please follow the instructions in the notice. If you do not receive your interview notice by October XX, 2014, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.
Also is saying at "next steps": We will assign your case to an officer. If an interview is required, we will notify you.
Should we expect the 2nd interview now or what???

In March 2015 we hired a lawyer.
He made an inquire at the USCIS in Chicago and he told us that the IO was transferred from GC interviews to citizenship interviews .... and that we will receive some news from them soon.
Also, we made online inquiries every month. Same answers every time.
Also we had an infopass! We spoke to a supervisor and she also told us to be patient and we will receive some news from them soon!
In October, 2015 will be a full year since the interview and NO GREENCARD!
Honestly we didn't expect this whole story ....

Now I wonder about biometrics! Was done in April 2014 ....
