I-485 Family Name change (she now has your surname)

Hello VJ's,

I've got a question about the I-485.

Here the scenario:

1. Fiancee enters USA
   
2. Applies for SSN
   
3. Get married (What if your fiancee takes your surname?)
   
4. File I-485
   • In Part 1 of the I-485 (Family Name) Do you use the original surname or do you use the fiance surname?

We filed Claudeth's AOS with her married name and social security wouldn't change her card until we have something official from the USCIS. When she received her EAD we went back to the social security office and they submitted the change. It took about six weeks to get the new card with her married name.

My wife came to the U.S. on a K-3. We filed the I-130 and the I-139F in her maiden name.....so it would match her passport and cedula (Colombian)....because it would take too long to process a name change in Colombia. Thus, her visa is in her maiden name. However, when I filed AOS and EAD, we filed in her married name. We simply added an addendum to each application explaining the situation -- that she was using her married surname in the U.S. and would like to have her applications processed with that name (of course, the Colombian marriage license indicates my last name, thus supporting our request). We did this on the advice of others on the board....who apparently have never had any problems.

Can't help you with the SS#...since she can't apply for one yet.
