Means tested benefits only come into play IF the beneficiary uses them. ;)

:thumbs: Right, but the point is those on the means tested list CANNOT be used as income to satisfy the poverty level requirement of which SSI is on the MTL. Therefor SSI cannot be included in the math when figuring the total income that the petitioner has. :pop:

hi.. thank for the reply.. actually his disability is not yet approve and he only start his leave from work last August.. and he approach his comp and they tell that they can't produce emp letter because of his status right now.. and he is just asking for a certificate for regular employee but still they can't provide it.. most of my research telling me its ok not to have emp letter ,he almost 3yrs working and we dont have issue on his salary.. but still chances it might be ask or not..thank s everyone.. maybe others will get something on this thread.. I only rely on vj and its really help me and feel good.. maybe we have to decide on what to do considering others insight... may be GoodLord help me to decide... godbless all.. :)

In your case, the company legally can't give him an employee letter without stating the facts of his current employment situation, which you really don't want a letter like that for your processing because it will do more harm then good.

USEM currently has not been asking for the employment letter, so not having it you should be fine. They may ask for it but I doubt it.

If he can produce a IRS 1040, W2's and current wage stubs, then he should be fine as long as it is over the poverty requirements for your household size. If it is, again no worries. But if you can't produce wage stubs that are current, that being within a few weeks of the interview, it may send up a red flag to the CO.

Right now it's best that you get an interview date now and get in and process so that the wage stubs are still fresh.
