Hi all,

I passed my behind the wheel test on July 20th and they told me to wait about 4 weeks to get my driver's license in the mail.

I now have a job offer so I'm really anxiously waiting to get my driver's ID.

I called DMV today to follow up and lady I spoke to said "I don't know how to explain this it may take 4-6 MONTHS of waiting because DMV is checking your legal presence with INS." She advised me to check the expiration of my temporary license and go back to DMV a month before expiration and get a new one.

My AOS is pending and I'm adjusting from K-1 visa. Please has anyone experienced this too? I can't believe the long wait!! Not sure why it's taking so long especially that I am legal here. :(

Do you already have a greencard? I do not see why it would take that long for you to get your license unless they are trying to accommodate all the Illegals that are trying to get Driver's License. That's why I made sure that my asawa got her DL before the start of this year. Which office did you go to?

I don't have my green card yet. I applied my AOS in February 2015 and received a potential interview waiver letter. I don't think I will have my green card anytime soon. I went to the Oxnard DMV here in Ventura County.

Having AOS pending by itself does not satisfy the legal presence documents requirements for a California driver's license. Did you use EAD or what did you use?

Yes, I have also heard that the checks take a long time unfortunately.

I used my EAD when I applied for the driver's license. Do you mean having EAD and pending AOS application do not satisfy my legal presence here? So technically, am I out of status until I get my green card?

I have a job offer pending background check which also includes a check with DMV. It's been 3 weeks but no results yet. Now I am paranoid if DMV is what's taking it so long. I just received a letter from my auto insurance policy that says:

"The Motor Vehicle Report for XXXX currently indicates a Pending Application license status with the Department of Motor Vehicles (DMV). This represents that the DMV may need additional information before the license status is updated to reflect as valid. Please contact your local driver's license office for more details."

I'm so confused. I wrote in my job application form that I have a valid driver's license which should be true even if what I have now is the temporary license right?

I meant that pending AOS by itself, even though you are staying legally, does not satisfy the requirements for getting a regular California driver's license. You need an EAD or valid I-94 to satisfy the requirements. This doesn't mean anything about your immigration situation; it's just the DMV requirements. So you shouldn't have been able to apply unless you had an EAD, which you did.

Thank you newacct!! For now, I have no choice but to keep waiting.. awaiting on DMV and AOS at the same time..
