Hi, everyone! I was a K-1 visa holder and now I am applying for AOS. We got a REF yesterday regarding to I-864. As my husband and I are very new to the process, we DIFINITELY need some help!!

1) My husband has no W2s

In REF, we are required to submit" W2s, 1099s and/or all schedules submitted to the IRS". My husband is self-employeed, he said he had no W2s, which is for employeed. What he filed for tax is Form 1040, and IRS never challenged about it. that's why we did not submit W2s last time.

What shall we do without W2s or 1099s? Does anyone have the same experience?

2) Do we need to submit Schedule F(profit or loss from Farming) of Form 1040, which is not applicable for us?

According to the instruction, they need COMPLETED schedules.

3) Which gross income is determined income, "adjusted gross income" in the first page of Form 1040 or "gross income" in Schedule C (profit or loss from business) of Form 1040?

We noted according to the instruction, it should be "the line for gross(total) income on IRS Form 1040". Unfortunately, the one of my husbands' is below the 125% of "proverty line". However, his gross income in schedule C (profit or loss from business), which is before deduction of expense, is much more above it. Can we use it to have a try, since Schedule C is also one part of Form 1040? Or we had better seek for any joint-sponsor immediately instead of waiting for another REF?

we received a RFE regarding our I-864 too. It says the same on there but if you keep reading it says :

statement in place of federal tax returns. if the sponsor was not required to file a federal tax return for the most recent tax year the sponsor must provide an explanation as to why s/he was not required to file a federal income tax return

Per my understanding, it means if we could not submit a federal tax return. However, now, we can but we just don't have W2s.

We are worried that our tax return will be considered "incompleted". Can we write an explaination for why we have no W2s or 1099s?
