F4 category for brother sister

pd 20 feb 2003

My mom is petitioner. She will start filling affidavit of support forms.

She does not work means no income of her but my dad works and files taxes every year as joint return with my mom.

What forms to fill out and which form belong to who?

Is my dad considered cosponsor?

Thanks

"Sponsor" means the person who fills out an I-864. The petitioner is always a sponsor. There may sometimes be a "joint sponsor", who is also a sponsor, but there is no joint sponsor in this case. The husband is a "household member" of the sponsor (petitioner).

My question has to do with I-864A page 3 of 8 Part 5. SPONSOR. My wife is filing to have her mother come here from the Philippines. She filed I-864 but needs for me to file I-864A - It looks like they want my wife's name listed as the sponsor and for my name to be listed page 4 of 8 as THE HOUSEHOLD MEMBER. This is not really clear in the instructions and when I called NVC the lady I talked to was not 100% sure either. Has anyone delt with this and if so, can you help me clarify this.

Thank you - Fred

In my case, my wife works but does not have sufficient income on her own, therefore I am a co-sponsor who must fill out the I-864A form - even so, I believe that I am still referred to as The Hosehold Member with my wife as the Sponsor as she is the one who filed the I-864 form and it is her mother that we are Petitioning for.

hi frdhill

you are correct, the petitioner is ALWAYS the primary sponsor, and files the i864 regardless of having income or not

the other person, in this case you, as her spouse will file the i864A as her household member and your income will be added to her i864 and you will be combining income to be able to cover the 3 of you
