HI Dwheels ,

My CC is on July 22 2015 and my interview is on 1st October 2015 in mumbai (india)

and I will be completing 2 years of my marriage in feb 20th 2016.

Also due to my work commitments I plan to leave for US to join my husband after our 2 year anniversary feb 20th 2016.

does this mean that I should file for form I-751. ??

I got little confused by seeing below link

http://www.uscis.gov/green-card/after-green-card-granted/conditional-permanent-residence/remove-conditions-permanent-residence-based-marriage

Please advice!

Why? You are a IR1/CR1 just like mentioned and others have posted. If you arrive after your 2 year wedding anniversary you will be sent the 10 year green card.

And just to let you know if you had to remove conditions (that's all the people married under 2 years at POE) you do that 2 years after you arrive in the US.

So again if you arrive after your 2 year anniversary you will get a 10 year green card. Be sure to have marriage certificate in your hands when you get t POE to remind the CBP.. Because in the system you will be listed as a 2 year green card.

No

Permanent Residence is not triggered until entry into the US. Even with an approved CR-1, you're not an LPR while in India. Therefore I-751 will not come into play while in India, if that's what you asked.

Ohakay ...Thank you Kieren ! I got it (F)

Thanks for the clarification dwheels !! (F)(F)(F)
