hi all. i've been lurking for awhile and i have a few questions. i am a u.s. citizen, and my fiance is irish, currently here visiting me on the visa waiver program. we've been engaged for around six months now, and were originally planning our wedding for next spring and were going to go the traditional route of the k1 visa, but our circumstances have changed slightly and we don't want to wait any longer. tired of the long distance, can't stand the thought of him leaving, and i have a four year old who is extremely attached to him and i hate to tear them apart as well. he arrived in the states at the end of july with a return ticket booked for october 12th, but we're now planning on getting married in the next few weeks and then adjusting his status. he was NOT questioned about his intentions during his interview when he arrived in the states, i don't think they even asked him who he was visiting, just stamped his passport and sent him on his way, so i don't think there's any problem there. during his last visit (january of this year) when he went through customs in dublin, they did ask him if we were going to get married while he was here and he said no, seeing as we weren't even engaged at the time. will that be an issue? we didn't get married on that trip, and that was nearly nine months ago, but i thought i'd mention it just in case. my other question is, is there a certain amount of time we need to have his adjustment of status filed during...? obviously the sooner the better, but money is a bit tight at the moment since we only have one income (mine, since he can't work here yet) and it may be a few months before we can actually afford to send in any of the paperwork. i realize that means he won't be able to work or leave the country etc in the meantime, which isn't an issue, i'm just wanting to make sure no one is going to be knocking on my door trying to deport him. thanks everyone for your help! :)

You will enter a new period of authorized stay once you file for AOS. ICE won't come pounding on your door looking for you as soon as you start accruing overstay before you file. Just get it filed as soon as you possibly can.
