Sent I-864 with mistake, can I correct before RFE?

Hi,

We sent the AOS package but we realized we made a mistake on the I-864 which will probably cause a RFE.

Should we send in a new i-864 form with a letter explaining the mistake, or should we wait for the RFE to come in?

Mistakes happen. It will be best to wait for RFE.

We made a mistake on a different form (I-129f - petition for a fiancé visa). I listed the wrong embassy in the form (The Hague instead of Amsterdam).

We did not wait for an RFE and my fiancé called the office responsible (I don't exactly recall which, sorry). We were told we could send a letter with the correction, including the case number that was already assigned to our case. I think it does not harm you to send such a correction, as long as you are very clear on what needs to be corrected and very clear which case needs to be changed. Worst case scenario is that they don't know what to do with it, don't take your correction into account and give you an RFE (that you would have gotten anyway)?

The NVC does not issue RFE's, they issue checklists.

Don't try sending a correct form without calling the NVC first and explaining the situation. Sending in the form in hopes of avoiding a checklist may

  • Not yield the desired result (they review the first form and you get a checklist anyway).
  • The corrected form you tried to send proactively doesn't get matched with your case.

As I previously alluded to, call the NVC, explain the error and see if you can go about sending a corrected form. Otherwise, wait for the checklist and be ready with the response.
