Also, ALWAYS double and triple check with immigration laws. There are many lawyers that don't give the correct information. Many horror stories on here of lawyers that have given incorrect information and the couple ends up suffering for it. If they tell you something other than what we are telling you, ask to see the legal proof.

...especially if you're paying them.

No one is understanding that we have already paid thousands of dollars for the mexico wedding, and all my family paid thousands of dollars to come. It is non-refundable so I cannot simply "move dates around" at this point. I'm contacting an attorney on Monday.

We all are understanding you dilemma. But without that AP (to reenter) you will be screwed. I have two friends who were in a bid and husbands had to up and leave to go back home before they got AP. Guess what happened when they tried to return? So now my friends have to file I-130 to get their husbands back here. It's been 9 months for one and 1 year for the other they still are stuck in NVC hell.

If you want to pay a lawyer that's great they can't change the laws for you. The best you can do is get married at courthouse like ASAP and file ASAP take your NOA1 make a INFOPASS appointment and request an Expedite. However, now your reason "because you want to get married and paid all this money" won't fly. AP really is suppose to be used for emergency situations not weddings and vacation.

Also keep checking your K1 calendar at your embassy see if you can move your date up.

NO If he leave prior to receiving his AP he will have abandoned his AOS and you will have to start all over with the spousal visa.

He can't leave until he has documents in hand. He comes, he marries, he files paperwork, and he stays until he has the AP document.

Ok.. I see. So he could come next week to marry me legally in the courthouse. And then we would file for AOS. And then he can go back to Mexico for his obligations. And then when his AOS card comes I take it to him in December when I go for our religious ceremony.

Will this work?

No, that won't work.

He needs to stay put until his AP card comes in the USA, then he can journey off to Mexico and return after your second wedding etc. without hassle. Being stuck in the USA for at least 60-90 days after filing AOS is one of the major catches of the K1 process.

Well then you're at fault for not doing the reasearch. Everyone understands what you're saying...seems like you're not understanding what they're saying.

His visa is good for six months just wait until after his "obligations" are done.

The visa is only good up until 6 months after the medical exam is completed, not necessarily 6 months after the visa is issued. Her issue is that she's already paid for a big wedding in Mexico and her fiance may not have his documents in order to be able to return if they leave before AP is issued.

Yes I understand that. No need in addressing the wedding as that's pointless so I was only addressing the obligation mentioned.

Forgive me if this is a misinformed suggestion...

The K-1 visa is valid LIKELY for another 4 months or so (depending on when he had his medical, since you have 6 months after this to enter the USA). Could maybe the fiancé stick it out in Mexico until December without entering the USA and attend his sister's wedding and also have their "ceremony" without the legalities of signing a license etc. in Mexico FIRST? And THEN after that the fiancé can enter the USA with the K-1 visa and actually get married?

The issue with this is that I'm not sure if the ceremonial "event", even without written documents, would be considered as a marriage due to cultural differences (the practice of this may invalidate the K-1 and so you would have to instead file for a spousal visa). Also your fiancé could not come to the USA for a little longer (but you could visit him)!

Can anyone shed some light on this suggestion? There's probably some flaw in it somewhere...

Unfortunately, anything viewed as a wedding could invalidate the K1 visa. Then they would have to start all over with a spousal visa. I don't think it is worth the risk.

The best option, in order to keep all plans and hopefully be able to get the AP would be for him to come ASAP, marry when he arrives, and file the AOS package immediately.

I just hope you can get your dates changed for the event in Mexico, or at least a refund. Then schedule much later.,.,.,as you just never know what delays that could come with the AOS

application

which most times goes very smooth, and sometimes, there are delays, and rfe's.

People on this site just believe that when making plans like this, the person should have their visa, AP card, or what ever, in hand, before making any type of big plans.

For your sake I do hope things work out for you, and maybe the "venues" you will use in Mexico can be set to a much later date.

Possible scenario? Wait until December to bring your fiance to the US after your little ceremony, but don't do the official ceremony- just have the reception in Mexico (so you're technically not legally wed) and then do the official ceremony in the US and stay there if you're that concerned about losing money. If you're really adamant about having it religious, maybe have the priest/pastor/whomever say a prayer and bless your upcoming wedding? Perhaps speak to them before hand to see what can be done.

But be warned that under absolutely no circumstances can your fiance enter and then leave the US and be able to return, picking up where things left off. If your fiance does not have AP (and not just the proof you filed for AP, the actual physical card/notification) you will lose everything you worked for and that is much worse than losing the money from the destination wedding.
