How long is the NOA2 valid for? We were planning to wait out nearly the whole 6 month period before entry simply because I am school, unless she got her visa late enough that it was less than 6 months before spring semester is over. Will that be a problem for us?

It is usually valid for 4 months from the approved date. But I read from here (if I'm not mistaken, from Greenbaum, that you can request for it to be extended for up to a year. If you go over a year, you will need to do the process all over again including payment.

Based on this: http://travel.state.gov/content/visas/en/immigrate/family/fiance-k-1.html 4 month from the issue date.

That POE denial doesn't make sense as K1 visa is valid for 6 month.... so how can visa be valid for more time than the K1 petition?

K1 process (after initial NOA2 approval) takes on at least 1 -2 month. And after visa is issued you have another 2 month to enter US? Doesn't sound right. There must have been some other reason why that person was denied entry.

You can get the NOA2 extended by 4 months at a time up to and including a year of validity. Basically people can get some crappy customs officers... your visa should be all you need but some look at your NOA2 approval as something that expires and wont let you in based on that alone.... splitting hairs as far as im concerned... so better to be safe than sorry and try to make sure you keep it valid.

Ok, just read that post again.

The refusal to travel to US was made by Canadian officials (at Toronto Airport). The person was not denied entry to US!

All it shows that Canadian officers took up to themselves to determine the eligibility whether the person would be or not allowed to enter US.

The was not issue with the visa, the officers had no(or poor) knowledge on how to read and understand the validity of such visa.

The problem was also in the Detroit airport if u read further down that thread. Just saying maybe keep an eye on your validity just in case.

How do I get the NOA2 extended when that time comes? I'm sure it will be longer than 4 months before she will come here because we are planning for a wedding in July. I do not want to have any problems. Do I do something on my end or does she have to go ti get it extended? Who do I call or contact? I don't want to send an email that gets no response or make a call that is just an automated system.

This whole deal is one of the reasons why we haven't set a wedding date. I'd rather just wait for our NOA2.....hoping and praying that will happen soon

We haven't set a date so much as I'm in school and being able to plan a wedding while I'm in classes is not something we intended to do. The plan was for her to arrive immediately after I finish classes in May, finish making wedding arrangements and have the wedding in July some time. Doing so sooner would be quite messy because we would not be able to live together plus her family that lives state-side would not be able to attend the wedding during school time because they all have kids in school. It just makes more sense to wait until she can come in July so that is why I want to know how to make sure we have no problems when she arrives. I do not want her sent back.

From this website: http://travel.state.gov/content/visas/en/immigrate/family/fiance-k-1.html#4

Q: My Petition Expired – Can It Be Extended?

A: The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.

So I guess, once your petition is approved, and has already been sent to your local embassy, and you need more time to process your K1 Visa, then you need to request an extension from your local embassy.

Yeah I totally understand...our plans are for him to come as soon as he has his visa in his hands. Initially the plan was for me to file in june when i moved to the stated, but that was extremely diificult (too much money and too little time) because our daughters 1st birthday is in January so we were hoping he'd be here by then....now were just hoping and praying its as soon as it can be...

I had to google the difference between "Embassy" and "Consulate", lol. So, an embassy refers to the physical building and a consulate is the government delegation.

I am a beneficiary from Manila, Philippines too, and as far as I know, there's only one place/consulate where all approved US petitions go -- which is the US Embassy here in Manila -- same place where all interview happens. That's where you will request an extension. Contact information below. Hope this helps!
