Actually Geo Pelaez was right, but half right.. What your lawyer is trying to do is process you for K3 visa not K1: http://www.visajourney.com/content/compare It's a lot faster compared to IR1/CR1 visa which could take a year or more to get approved. K3 visa on the other hand is just like K1 but for married couples.. You file the I-130 followed by the I-129F form. If the I-129F form gets approved first then u fall for K3, but if the I-130 gets approved first I'm sorry but you have to go follow IR1/CR1 visa. One of September filers who's not here anymore is the same with ur case but his I-130 got approved first so he falls to IR1/CR1 visa.. Good luck on your journey!

thanks for the reply but i was told by my lawyer that even though i was married i could still get the k1 visa for faster process to bring my wife meanwhile she can stay with me and wait for the green card.

I don't want to start an argument, but your lawyer is misinformed. One of the basic requirements for a K-1 visa is that you are current not legally married and that you are free to marry. Anyone here will tell you this. Sorry.

yes. i knoe but form I-129f has to do with the visa for married couples to bring their wife faster. but thanks for the help really appreciate it.

Sorry but form I129F is for Fiancé Visas, not for married couples. Hire a new lawyer or do some reading on our own. Best of luck

We got visa approved today! ?? Thank you for all your support! Hope everyone get their approval also. ? I am just confused because they did not get our I134 for affidavit of support. Lol
