No you don't have to wait. Details of what to do next can be found on my website for processing through the PHILIPPINES.

We did not wait. We have everything set to go. DS-160 complete and fee paid, she has all of her required documents and I have sent all documents she needs from me, we have her interview set for Dec 4th. However, NVC has not sent our case to the embassy. All I get from them when I call them is that it's in administrative processing and could take up to 42 days to be sent. If NVC has not sent our petition, she can't do her interview, correct? Any advice is greatly appreciated. Getting rather frustrated and stressed with NVC.

That is really strange that your case has not arrived. She can't have the interview if your file is not at USEM. Here is what I recommend and in this order.

  1. Contact NVC and asked to be passed to a supervisor or a Tier 2 representative. Explain your situation and blah blah blah (you know what to do and say)
  2. Try contacting through email the Ombudsman at cisombudsman@HQ.DHS.GOV The Ombudsman provides an impartial and independent perspective to USCIS in an attempt to resolve problems.
  3. Contact USEM by phone and see what they can do for you and whether you need to change your appointment.
  4. Last schedule an INFOPASS appointment through the following link: https://infopass.uscis.gov/
  5. Last but not to be forgotten contact your congressman(woman)

Thank you everyone!!!! Thank you so much!! :D

So, it was pretty fast...I gotta say: Naples people are so warm and so Consulate officers there.

The lady asked me only three questions: - how did you meet? - how old is he? - what does he do?

It was completely in italian, they didn't even ask me what language I prefered. They were all smiling all the day.

I had a F1 visa denied last June, I thought it would have been a problem, but they didn't even ask me about it.

The officer told me that my case was super easy (I lived one year in America), and I was approved! Visa should arrive in 5 days :D

Thanks for the advice. Our status still says "at NVC". I'm not sure what the hold up is. They have had it for 2 weeks now!! Praying it will get sent soon.

Really, there's not need to be worried if you have everything you need.

I got frustrated for all the past months over a thing that I could just not be worried about it.

Hey guys I have a q. I'm getting the I-134 ready but I'm just starting a new job since I've been home with our baby up until now. How many months pay stubs should I send when the time comes? And will it be a problem that I haven't been working up until now. My salary is well over the range but I just want to make sure I gave my bases covered.

I'm not sure what they look for exactly, but I technically do make all the requirements- my income for the year/last few years of taxes are enough, but because I don't have a current income that covers the minimum, I used a joint sponsor, just to be on the safe side. If they have any questions- my fiancé will just explain exactly that- that I do meet the requirements but that we have backup just in case. I don't know if that's an option for you, but I'm trying to be as cautious as possible!

They said they need to check with their lawyer because they aren't sure if it's legal for us to get married in DC but live in Louisiana.

Reason is, she is 17 and in Louisiana her father has to be here to consent vs in DC (where my family lives) they accept written consent. I checked the Louisiana laws and we are all good!

Hope this resolves quickly

I hope so. I tried to email the Embassy with an explanation and a copy of the laws that say its allowed, but i get an automated response saying "high email volume..blah blah blah.... if your case is in administrative processing we will not reply to your email...blah blah blah..." Ive never received an automated email from them before, strange
