Hi,

I am applying for AOS and I am filing all of the required forms in the I 485 package.

Now I got few concerns about the correct Last name to use on those forms.

Here is my case: >>> Below is not my real name but a sample for the purpose of clarification

  • We got married and when we received the marriage certificate, my name on it is "Jessica Johndrow" which same as it appears on my foreign passport
  • We applied for Social Security card, and requested my husband's last name to be added on it. So now my name on the SS Card will be like this:

First: Jessica

Last: Johndrow Elam

My question is:

What should I use as my last name when I file all of the forms in the I 485 Package? Should I use my new last name that I put on the SS Card which is "Johndrow Elam" or I should use my last name that is on the the marriage certificate which is "Johndrow" ??

You use your current married name. If your married name is Jessica Johndrow Elam, then this is the name you will use on all AOS forms.

You will use the name you intend on using after marriage. The marriage certificate acts as your legal name change document, even in states where your choice for name after marriage is not shown on the certificate.. The name you use on the AOS forms is the name your EAD/AP and green card will come in.

so I should use my name that will appear on my social security NOT what is on the marriage certificate??

Forget about the SSN and the certificate for a moment. Which name are you planning on using as your married name? To sign with on future documents etc? That's the name you should use for AOS and that's the name that will be on your Green Card.

Not sure if this old post will get a response. Having investigated this same issue over and over again everywhere, the information is still conflicting. But in this thread, the last two posts seemed to have summed it up best for me....

 

So, given the last two responses I want to ask this....So then if my wife wanted to be called Mickey Mouse...I could put that on the i-485? Sure it could be rejected for foolishness, but let's forget about that. Sounds like I put whatever name I want regardless of all past legal documented names.

There is a space for previous names on the I-485, so be sure to use your maiden name for that section that way all your bases are covered. When my husband went to get his Biometrics done we had to go into the office of the supervisor because the form was in his married name but he didn't have any ID with that name on it. We got an earful (and a lot of judgment) from the male supervisor who couldn't understand why my husband took my last name and insisted that the marriage certificate is NOT a legal way to change the name.

firstly, start your new thread and don't hijack old ones for your new inquiries,and you will be more likely to get a response if you post in the right forum, so if you look in the AOS section, there are many posts on this topic. Secondly, No you can't choose Mickey Mouse because you don't have any documentation that supports this as your legal name. Your fist name and old last name is on all your documents (passport, marriage certificate etc). The new last name is your husband's last name on the marriage certificate. The legal act of getting married grants you the right to use the lat name of the spouse if you so wish, hence this document is the legal name change document.

Don't know what to say, other than that's wrong, (what the supervisor told you) but you are not the first it has happened to. For most people it's never a problem though, as it shouldn't be. It's true that it isn't a primary form of identification (hence many banks etc won't allow you to use the certificate to change name until you have your EAD/AP combo card which is a primary ID document) but it is enough of evidence to show the uscis that you will be using this name - IF you have put it on your applications. If you haven't put the new name on your applications, then likely you could be asked to change it on the card after you get it. Some ppl have been able to get this sorted at the biometrics with some hassle though.

I figured, but we weren't really in a position to argue. We had all of our forms (filed with both names) and marriage certificate and he still wasn't budging. I couldn't believe he actually said that if it was me as the beneficiary it would be different but since it was my husband it wasn't a legal name change. For anyone else reading this in the future, USCIS addressed notices to my husband with his married name so it wasn't an issue outside of Biometrics.

lol that just goes to show how dumb he was... why would it be legally different cause he's a man.... omg.. the ignorance.. smh... sorry about that..
