Yeah, I've heard there's no difference in card issued. In fact, the lady was like "she'll only be able to work until October 17th, then she can't until she gets her EAD". So I mean that was news to me, Danielle has no intention of working until she gets her EAD, so I assume it's just more or less flags that are lowered and raised "in the system".

It is the same whether or not you get the SSN via the I-94 or the EAD. The card will have the stipulation on it that it is only valid with DHS authorization. The EAD is that authorization. She cannot work with just the SSN alone and no EAD. That SSA worker has no clue what she is doing or talking about. Once she gets her AOS approved and has her green card, she will no longer require employment authorization and is free to work as a lawful permanent resident. She can take her green card to the SSA to update her status and get a new SS card without that stipulation on it at that time.

Just take the EAD with the married name on it(and marriage cert.) back to the SSA once she receives it, and get the name changed to her married name.

You mean take the EAD or I-94 right? I believe hers is still valid?

No, I mean the EAD. For this couple to avoid further hassles with this SSA office, I think that is the best bet. They SHOULD be able to get the SSN in the married name using the marriage certificate, but many K-1 entrants find that not to be the case for them. It is easier to apply for the SSN in the maiden name, then return with the EAD in married name to get it changed on the SSN. The VISA name, which is the maiden name, is what is in their system and allows them to be eligible for the SSN. So, it is typically much easier to get the SSN in maiden name, whether married yet or not, then change it once you have the government ID(EAD) in the new married name.

That's pretty much what that lady told us. Even though she was so adament on not letting us get a SSN to begin with... lol

Just got the e-mail notification today (a week after sending it in, so 2-3 business days after them receiving it), saying they have accepted it and routed it to the USCIS National Benefits Center for processing, should be receving I-797 in 7-10 days. Which one of the applications does this apply to, the AOS, EAD, or AP?

Thanks! I was surprised at how quickly they sent the emailed, considering it took a couple weeks for the I-129F petition (which they sent 5 identical emails).

So it says "this notice can not be used as proof or evidence of immigration status or pending case status". That being said, in order for Daneille to get a State ID card, we need to show that she is allowed to be in the conutnry for at least 6 months, with at least 3 months remaining. What document shows this? I am thinking the I-797, but that little snippet at the end of the email gives me doubts.

The notice just confirms that she is in a period of authorized stay at the moment, but in a grey area as far as true immigration status is concerned. I agree with above poster that she'll likely need to wait for her EAD to get any further identification at this point.

Yeah I guess I'll have to call the DMV... again. In Wisconsin, other than the typical proof of residency and whatnot, theo nly special thing was the "6 months with 3 months remaining" stipulation, so I didn't know if that's covered in any document during this process. I assume the EAD has an expiration date on it, so maybe that will help.

Thanks, that's good to hear. Now I just got to hope that the people at the DMW can work with that. When I called them they said that though her passport is in her maiden name, with a marriage certificate (and her EAD/AP being in her married name when she gets it), that they can connect the dots and do it with her married name. That's what the call center people said, just like the call center people for the SSA said, and we all saw how that panned out.... I swear, they make doing thinks the right way and legit so dang hard.

Checked my bank account, they cashed the check, so that's good, right?

Also we got Danielle's SSN today in the mail (in her maiden name, of course), didn't know it had the words "Valid for work only with DHS Authorization" stamped on it.

Why wouldn't it? She's not a permanent resident yet.
