I-485

Ok guys, I've searched and searched to try and come up with the answer to this question on my own and I'm coming up with zero luck! My husband and I are filling out the I-485 and in "Part 2. Application Type", we are not exactly sure which category to select. Just for info, I'm a USC, my husband is adjusting from VWP. I'm pretty sure we should select "h. Other basis of elegibility. Explain.", and then say adjusting from VWP due to marriage to American citizen while on vacation. Am I right? Any thoughts? I appreciate any input!

It's the smallest of technicalities that get confusing, eh?

The answer is "A". You're filing I-130 concurrently with I-485, which gives you an immidiate visa number. The "already approved" bit is a throwback from when you used to have I-130 approved before you filed I-485. It doesn't sound like it should be the right answer, but trust me its "A"!

Also....I'm not sure....do I need to fill out the form I-485 Supplement A? I can't tell if I'm eligible OR if I'm supposed to pay the fee as well?? I'm so not good at decifering technical writing on forms lol.

And another question when filling out this form.....When it asks for my husbands USCIS status...do I put none? or visitor? and for date it expries, put the date it DID expire? forgive me lol.

I just got done speaking with USCIS and asked about this very same question. Our cases are different in that my husband entered on a fiance visa (K-1). Since we are now married, the K-1 technically isn't valid anymore, so I had no idea what to put for the answer to that question on the I-485. USCIS asked me under what status did he enter the US? I said the K-1 and she said that is what you need to put as your answer.

It wouldn't hurt to call the USCIS to double check though since our cases aren't the exact same even though I think the answer may very well be the same.
