I received my Packet-3 from Montreal late last week and below are my concerns.

"STEP ONE" mentions that we complete and immediately return to the office the enclosed Form DS-230 Part I, and DS-156 in duplicate. It also says that DS-156 is to be completeled electronically as it uses the barcode print-- which is not a problem, I can do that.

It continues to mention that Form DS-156K (Nonimmigrant Fiance(e) Visa Application) should be completed in single copy (this form was enclsosed in my Packet3, so I should fill this form out and send it to them?)

"STEP TWO" mentions about the check list of the birth certificate, police certificates, photos, passport, etc, etc. that you need to send back to Montreal once you have all the items pertaining to you in hand-- can i send this Check list ASAP with all items pertaining to me ticked off even if there is a police certificate that is still to be received in my hand?

My Question:

When I look at DS-156K form that was sent to me, mid way the form (after section 5), it reads "THE FOLLOWING DOCUMENTS MUST BE ATTACHED IN ORDER TO APPLY FOR A FIANCE(E) NONIMMIGRANT CISA", after which it lists the items such as birth certificate, marraiage certificate, police certificates, etc, etc.

Do I have to send these items listed in Form DS-156K when i send DS-156K back to Montreal along with DS-230 and DS-156?? (as noted in STEP ONE above)

I am a little bit confused as to what needs to be returned to Montreal and even that ASAP!!!

Am I to send back to Montreal:

1) Form DS-230 Part I

2) DS-156 (two copies electronically filled)

3) DS-156K (should I send birth certificate, police cert, etc.??) or just fill out the form and send this??

4) I-134 Affidavit of Support

Any thoughts on what I should actually be sending out to Montreal?

I just went through the same thing as you, except I was in Bangkok with my fiancee and had limited internet access. I made the decision to just go ahead and include it all, even the I134. I also included a copy of her passport and two photos, as I've heard that the Embassy will ask for this later (before interview), and not having it will only delay. My fiancee has copies of everything should they request them at the interview. We'll see. Lesson learned through this is better too much than too little.

I empathize with your confusion and please send me a personal message if you or someone else can cite a conscise explanation.

05/16/2007 Interview. Embassy requests passport amended. Luckily the turnaround time is two days in Bangkok.

05/21/2007 Pu returns to Embassy with new passport, visa granted. Visa issued the following day.

05/26/2007 Pu arrives in USA!

05/30/2007 Married!

06/26/2007 Overnighted AOS petition to Chicago Lockbox

06/27/2007 AOS petition delivered to Chicago lockbox, signed for by V Bustamante

Are you sure it says to send back the DS 156 and 156K with the DS-230? When I had to send everything back, I had to take the DS-156 and 156K to the interview with me.

I also filled in the DS-156K electronically and it was fine.

Yes ... send it back even if you don't have everything in your hands.

I am reluctant to send any of my original certificates in the mail. But do what the instructions tell you. Can you type them here?

Yes to the DS-230 Part I

As for the DS 156 and 156K - I'm not sure. Again, if you type the contents of that part of the letter here, I should be able to help you out more. Things may be different now.

The I-134 (unless things have changed) should be taken with you to the interview.

I just recieved my packet 3 recently as well (speaking of which, I better get it sent back soon :P).

The wording in the first section of the packet is confusing. It states exactly as follows:

"A. STEP ONE. Please complete and return immediately to this office the enclosed From DS-230 Part 1, Application for Immigrant Visa and Alien Registration and the Form DS-156 in duplicate. All forms DS-156 are required to be completed in an electronically-completed format, available through the Internet. Hand written DS-156s will NOT be accepted. You can complete your forms DS-156 on line at http://evisaforms.state.gov in either French or English. Please print out two copies of the entire form, including the barcode on page 3, and send them in to this office. This new electronic format does not apply to Form DS-230. Complete the single copy of the Form DS-156K, Noimmigrant Fiance(e) Visa Application."

Please note the bolded sections. You are to send back the DS-230 Part 1 and the DS-156 ONLY (along with the checklist, of course). The DS-156K is NOT to be sent back at this time. It's really unfortunate that they decided to throw it in at the end of the paragraph rather than have it as a separate item. It just reads very poorly this way.

This sounds like good advice and I see that they have changed their requirements once again! If you still wanted to be sure you were doing the right thing, shoot them off an email.

The checklist instructions can be confusing. Instead of saying something like "in duplicate", they should say "two copies" because I was looking forever for the form "DS-156 In Duplicate".

No seriously I was, until it dawned on me that they meant, print out 2 copies. :P

any estimates as to how long before i get to hear from them?? and how long before it's safe to contact them??
