The Affidavit of support by a retired US husband

Hi VJ members , my husband and I started the process in 2014 and the petition got approved by USCIS , we received our case number by NVC , but everything got frozen may be for a period of time or for good , I don't know . we are not young couples I am 53 and my husband is 69 and he is retired , now he has to fill in the affidavit of support to be sent to NVC for processing our visa, but he didn't because he doesn't have a job and told me that his social security is not enough for supporting us , and he needs to get a job I do not know whether he could do that at his age or not , and if he could that would take years till we relocate . what should we do ? he has his own house in America ? Any advice please ?

What do you mean frozen for a period of time or for good?

Your husband doesn't need to obtain a job. He can just try and find a joint sponsor who will be willing to sponsor you.

Or, your husband could use assets instead to prove that he has enough to support you. For spouses, he needs assets three times the necessary income. He can combine this with his SSA income so it would be 3 times the difference between poverty guidelines and his SSA income.

What do you mean frozen for a period of time or for good?

Your husband doesn't need to obtain a job. He can just try and find a joint sponsor who will be willing to sponsor you.

Or, your husband could use assets instead to prove that he has enough to support you. For spouses, he needs assets three times the necessary income. He can combine this with his SSA income so it would be 3 times the difference between poverty guidelines and his SSA income.

I mean every thing got frozen by my husband , because he believed that NVC may denied our case as he doesn't have the financial ability to support us , does his house , 2 cars can help or not

This is from the I-864 instructions:

Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis for the owner’s claim of its net cash value.

You may include the net value of your home as an asset. The net value of the home is the appraised value of the home, minus the sum of any and all loans secured by a mortgage, trust deed, or other lien on the home. If you wish to include the net value of your home, then you must include documentation demonstrating that you own it, a recent appraisal by a licensed appraiser, and evidence of the amount of any and all loans secured by a mortgage, trust deed, or other lien on the home. You may not include the net value of an automobile unless you show that you have more than one automobile, and at least one automobile is not included as an asset.

at this stage, ask your husband to seek a joint-sponsor. it's allowed, really !

he'll submit:

1. HIS I-864 and

2. the joint-sponsor's I-864

there's other tax/income paperwork to go along with it.

That was our plan from the beginning , and he kept coming and going 3 times a year . but he got tired of long flights +plus he didn't trust doctors here

Now after hearing about what is happening to black people in some part of America specially during Trump's rally , I don't think I want to move to US even if I get the visa , America will not be safe any more for black African
