Hi everybody!

I came here with a F1 visa. I applied for OPT, EAD card, I couldn't find a job. So I overstayed.

I got married on Aug 15, 2015, with my boyfriend who I met 3 years ago. He is a US Citizen through naturalization.

We are now getting ready to begin our AOS journey. I have a couple of questions, I would appreciate if you can help me!

1. for the I-130, I-485 packages. should I send them both in the same envelope?

If separate envolopes, do I need two different checks? or just one with the total amount.

2. We got married in Florida, and I want to take his last name, our marriage license has my maiden last names. He has two last names (Hispanic), But I just want to take his FatherLN. Do I have to fill the forms (I-130 and I-485) with my new last name? or just I-485.

3. WHAT is this for --> I-601, Application for Waiver of Grounds of Excludability**, if applicable

4. As soon as I fill my applications, when can I get a Driver's licence? I have never had one before.

2. want a new name? USCIS studies the marriage certificate - what's there?

3. I don't think you'll need it, as overstay is forgiven when 1) married to a USCitizen and 2) green card is issued.

4. No. Usually can get one when you have the EAD card in hand - suggest you file the I-765 with the I-485, as filing fee for I-765 is waived when included with the I-485.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

i dunno about that one, really, any concept of marriage certificate NOT showing the new married name.

Sorry.

As a last resort, could go to a county courthouse, pay a hefty fee, and get yer legal name changed to a new legal name,

then use the court document stating the name change.

I am experiencing the same dilemma. My husband and I got married a month ago and we're trying to figure out the proper way of filling out this forms without the hefty lawyer fees. We already talked to a lawyer and lost quite a bit of money and received no help. I suggest you dig around the forums and other forums. If I find anything I will let you know. I wish you and I luck in this extensive process!

I read in another web site that you file all the forms with your married name if you want, I just fill my forms also and my MC has my maiden name as I got married in FL but the attorney said that is no problem to take your husband name as everything is verify with the marriage certificate so don't worry!

I'm surprise you got married and not add his last name. You suppose to add and use his last name after you get married.

Fill all your forms with your husband las name, then write your maiden name in the part that says "other names including maiden name"

Even your medical you write your married name, I did it and they didnt even asked me for my marriage certificate to fill the I-693
