I-864 past tax returns and current employment/income question.

I am helping a friend with an AOS package for his wife.

As usuall there is the most confusion about Affidavit of Support. His adjusted gross income for the past years is as follows (on IRS transcripts) This is for the family of two in Connecticut:

2014 - 23,114.00

2013 - 30,287.00

2012 - 28,864.00

My question is about the current income. He is working part time as a teller (17,784.00 a year) and part time as a waiter (5.78 per hour + tips/weekly net pay $100-200). He has had a bank job since March of this year and restaurant job since May of this year. It is hard to determine his current income since it changes from week to week.

So far we have for documentation:

tax transcripts, printed out itemized tax returns, W2s - all for the past three years

current: employment letter from both employers, pay stubs for the last few months

What should I write in the current income column Part 6, question 2. Is it going to be the number from 2014 tax return (23,114.00)? Since his current income varies from week to week.

I would really appreciate your help.

Did he use the 1040EZ? That is the only one that you list AGI from. If using any other 1040 form, then you list the Total Income line for the questions about the last 3 years of taxes.

Can you calculate a rough estimate of how much he will earn from the waiter job in a year annually? Then add that with the annual income from the teller job to get the current annual income. The letters from his employers and pay stubs from both jobs will back up the current amount listed. You can also go with the Total Income amount from the 2014 return, but if the current income is significantly greater, then I would go with the estimate.

I suppose in this situation it is better to use 2014 income. The form from IRS I have is 1040 and is listing AGi as 23,114.00. When I calculate the averages from both of his current jobs it is about the same, but the check amounts vary from week to week.

Is it ok if I just write in part 6, question 2 the AGI from 2014? I will also submit current employment letters from both employers and all of the pay stubs.

Also, does it matter that about $4,000 of income from 2014 came from cashing his 401K?

Any responses greatly appreciated.

Yes, you can just use the amount from the 2014 taxes and still provide the letters from employers and pay stubs from both jobs, especially if the current income estimate is close to that amount anyway.

Thank you so much for your help. When calculating an estimate of earnings from restaurant, do I take gross or net pay into consideration?

Also, should I count income from bank as 10 months, since he started in March; and restaurant income as 6/7 months since he started in May.

Timeline

Gross income, always before taxes.

You don't calculate based on how long you have worked there so far. You calculate how much you would earn in an entire year at the current pay rate you are receiving. For example, if you make $10 an hour and work 40 hours a week, then that is $300 a week, You then multiply the weekly amount by 52 weeks, which in this case would be $20,800 annually.
