Good morning! I have a question.

I want to ask if how long does USCIS usually take to review and make a decision after it receive response to a RFE?

We received a RFE last June for my I-485 application and responded in July. The last update I got is that 'Response to RFE Was Received'. That was 5 weeks ago.

Hey there,

From what I have heard and experienced, the National Benefits Center has been backlogged for about a year now. We filed the I-130 and I-485 concurrently and it was received by the NBC on February 10, 2015. Then, we received an RFE in February and another one in March (to do with 2014 tax records). They received the last evidence they requested on April 15, 2015 and my status hasn't updated since then! It's been over 4 months now and almost 7 months since they received my case. I've called the 800 number and told them the USCIS processing times webpage doesn't list I-130 processing times for the NBC. They told me that basically means they process it on their own time! Originally, when they received received my last set of evidence, it said that they would take action or make a decision by June 14, 2015. Well, when that day came and went, suddenly that June 14 date was removed.

I called one of Michigan's U.S. Senate offices to see if they could look into it. They helped expedite my EAD/AP (got it approved just 3 days after asking for their help!). But, they called me back and basically said that I have to wait for the I-130 to get approved. Then, everything will go to the local field office in Detroit and they'll schedule me for an interview.

This site does help though, as it does post an approximate date that I-130's for IR1/CR1 are being processed at the NBC. Today it says they are up to January 8, 2015. But, again, that is just for the I-130. After that is approved, I believe you have to wait till about a month before your local field office reaches the priority date for your I-485, before you get scheduled for an interview. They just updated the processing times for the field offices recently. For the Detroit office, they are processing I-485's from October 22, 2014.... so, again, a bit of a backlog. The Michigan Senator's office told me it's been like this since about October of last year. Things were moving a lot faster in the early part of last year. I had a Niece move from Canada to Michigan via her husband and, she got her Greencard in just under 4 months!!!

did the request for evidence come from the national benefits center? It should have come from a local office. The request for evidence should be reviewed within 60 days. If you have not been notified, put in a service request.

Hey I've been waiting on RFE review for almost 2 months. Do you think you can tell me about asking the U.S. Senator about my case? How does that work?

Hi everyone, 

 

My husband got an RFE last week, they are asking for documents to prove we have a valid marriage and that it wasn't for immigration (as if). One of the suggested documents is sworn affidavits by people with personal knowledge of the validity of the marriage, but we are having a hard time giving guidance to those who are writing them for us. They seem pretty formal (full name, DOB, address, place of birth) but ask how the person knows about the marriage. Some people have said to just gush, but in a sworn affidavit I'm not sure if that's the right direction? Does anyone have any examples or experiences with this? Thanks!
