Some Technical questions on the I-751 form

Hi all,

I'm getting ready to file the I-751 form for removing the conditions for my wife. I'm a US citizen and will be filing the form next month. Here are some of my questions on the I-751 form:

1) Do I have to include two passport sized photographs for my wife when we file this form?

2) The total fee required to be mailed is $275.00? And i'm assuming - preferred is Cashier's check or money order?

3) On part 1 of the form, for the address and mailing address sections, the C O (in care of) section, what should I put there for that? Me and my wife live in the same apartment - sharing the same last name. For our mailing address, we are using a PO Box address which is under my name only - should I put down in care of my full name for the mailing address?

4) On part 3 of the form, for other names used, my wife has only used her married name since we got married back in India almost 3 years ago. Even her indian passport has her married name on it. Should I put down "None" on that part or should we include her maiden name?

5) On part 3 of the form, for item 4: If your spouse is deceased, give the date of death - I'm assuming I put down "N/A" right instead of keeping it blank?

6) On part 4 of the form, for information of A#(if any) - I don't have one since i'm a US citizen, so what should I put down - "None", "N/A", or keep it blank?

7) On part 5 of the form, we don't have any children, so should I put down "None" or "N/A" or keep it blank?

8) Last question is - how will INS know that I'm a US citizen filing and my wife is applying for this petition married to a US citizen - the form does't emphasize that? Should I attach a photocopy of my US passport?

I know these are very specific related questions - but I appreciate the help since you all are going through this process.

No

Personal check is probably preferred, so you can see when its cashed

Not sure about this one - PO Boxes might be unusual - I'm sure others will weigh in on this

I would include her maiden name, because it says that in the line above the box

N/A sounds right to me

As I said above, the form is written from the perspective of the immigrant, by the nature of asking to remove conditions, she has to have gained residency from a USC spouse.

I know these are very specific related questions - but I appreciate the help since you all are going through this process.

Thanks for your answers - anyone else wanting to give me their input on my questions.

Also, for the PO Box address - i'm only using that as our mailing address since we are getting our house constructed right now and not sure when we will have to move to it. Could be June/July/or even August at latest. Should I add anything for the care of section for the addresses?

The instructions to form I-751 say you don't have to.

2) The total fee required to be mailed is $275.00? And i'm assuming - preferred is Cashier's check or money order?

As of today, it is $275. Personal check is fine -- also in the instructions. We sent a personal check and it was accepted.

3) On part 1 of the form, for the address and mailing address sections, the C O (in care of) section, what should I put there for that? Again from the instructions: "Indicate that an item is not applicable with "N/A." If an answer is "none," write "none." "

Put "N/A" in the "c/o" blank if you are not having mail sent to you in care of someone else.

I would include the maiden name as well as any other name she has ever used.

Again, instructions are to "Indicate that an item is not applicable with "N/A." If an answer is "none," write "none." "

Put N/A.

"None" because you don't have one.

Your wife is the one filing. You just sign on the second signature line ("Signature of Spouse"). USCIS will know that your wife is married to a USC because she will have checked off that box in Part 2. No need to attach a photocopy of your passport. They have a file on you/your wife already and they wouldn't have granted her conditional GC in the first place if you hadn't been a USC.

"When all else fails, read the instructions."
