Going to USA until Medical/Interview date?

I've been told today that no more interviews are being scheduled in September so I'm likely to get an interview date for October. My case is still yet to be completed so it could be even later.

I'm thinking about going to the states to be with my husband until the date of my medical (which I'll book while I'm out there once I get my interview date).

I know you can visit the states with an IR1/CR1 in progress and I'm from the UK so I can travel on VWP. Just want to see if anyone else has any thoughts on this plan? Would I be doing anything that I'm not supposed to be doing?

Thanks guys!

Nope

Many people visit during the process, I did.

Oh I see. Yes I've visited before for a couple of months so this will be no different I suppose. Just felt different cause we're so near the 'end'. At least it's lifted a bit of the weight of this waiting game.

Just make sure you don't stay longer than the 90 days, bring proof of ties to your home country (if any at this stage) and maybe even proof of where you are in the process.

I'm planning on doing the same thing. I've already sold my apartment plus I lost my job when they found out I'm planning on moving to the US so I don't really have anything to do back home. NVC has messed up our case and we've been on supervisor review for 61 days now. Spoke to the US embassy in Sweden and they said that people with case complete in august/beginning of September probably won't get interviews until mid-November now. Since you don't have cc either, you can probably also count interview earliest in November. :(

I see your husband is also in a warm state, I say go wait out your interview with him in the sun by the pool. :) I'm flying over on September 23rd, unless some visa miracle happens before then.

I have done it. I got CC and had a travel planned to see my husband two days after. Just in case I printed the confirmation letter that I have CC to show them that I´m planning on immigrating legally and then I just had my return ticket to show them. They didn't ask for any proof at all.

Oh god, we're still on supervisor review for a stupid checklist too! I just wish they'd complete our case already - every time I call they say 'it should be complete this week'. Lies!

That's crazy that interviews will prob be in November now! This is ridiculous. At least we're able to go there now. I've booked my flight for Sept 16th so like you said, unless some miracle happens, I'll be going then.

Good luck to you both!!

Glad to know you've done it and all was well. I'm hoping it'll be the same for me too. I always get worried saying I'm visiting my husband when I get to the border but really if you have all proof and no reason for them to suspect you're not going back, there's no reason to be afraid (I hope!).

They've been telling us that for weeks now too. First the excuse was that the supervisor had 45 days to complete the review. Once the 45 days were up, they kept telling us it should be any day now or some lame reason why it wasn't 45 days yet. Thinking we probably have the same lazy, incompetent supervisor reviewing our cases... We're gonna involve our Senator and also make a formal complaint against the supervisor. However that is made?!

Hey Amber,

I stayed 45 days in the US last march - may and had no problem. I printed a few proofs that I have attachment in France (job, school, rent or apartment deed work) but didn't have to show anything

Last time i came though, before our wedding, I was put in a room for 2 hours and asked many questions before being let go. So I was concerned this event would be written somewhere and cause me trouble.
