Hello all just got married a couple weeks ago and we would like to file for an AOS but I had some questions.

Can I fill out most of the forms on the computer and then print them out or do they all have to be hand written?

Can I send the I-130 and I-485 at the same time?

Does my spouse need to see a doctor for the i-693 before I send the package in or can we wait till the interview/etc to bring it?

Do I still fill out a I-864 if my income is not high enough? Or Do I just have my joint sponsers fill it out.

What is the Electronic I94 Copy? Do I need to submit this

Also I am following this guide for my AOS process

Hello:

You have to send the I-130 First and them when you have the approve, send the I-485

yes you have to fill out the I-864 and your joint sponsor too

yes you have to submit the electronic I-94 form you can find out in

www.I94.cbp.dhs.gov

I read I can file the I-130 and I-485 together. My spouse is in the US already. A last question I had was She will overstay her visa in 40 days. If I file all of this within 2 weeks will it cause any problems or should the mail be received by this time and will the visa overstay matter?

File as soon as possible is the general forum recommendation for AOS.

You should definitely file I-130 and I-485 together. Why would you file them separately? There is no benefit plus it's a very bad idea because 1) then it would take much longer and 2) only filing the I-485 protects you against deportation; when you go out of status you become deportable plus you filed I-130 so you notified the government that you're here so they can deport you.

They can do a concurrent filing of the I-130 and I-485.

There is absolutely no good reason to file the I-130 first and wait 5-6 months for approval before filing the I-485.

Overstay is forgiven for the spouse of a USC once you file. It's not a problem.
