Potential Waiver Interview Case.

Hi there! I received this potential waiver interview last January 16,2015, and until now I haven't received my green card yet. Whenever I check it online it's still the same status since January.

Note: We used to live in California when we filed my AOS and moved here in Nevada, got my address changed too. I'm wondering if it does affect the delay of my green card because they transferred my case here?.

And my work permit will expire soon and I don't want to get terminated.

It's hard to say how long it will take, you can renew your work card 90 days before it expires so you can continue working, and it's free with a pending AOS. We didn't get the interview waiver and it took 16 months for our greencard to be approved, 12 months just to get the interview. We were finally notified last week the green card is coming.

Does it affect my change of address that's why my greencard is out of the processing time? And how long does it takes before we recieve the mee work permit after we renew it?

You should file for renewal AP and EADs 120 days before your current documents will expire, since it can take up to 90 days to process the replacements.

You should renew 90 before expire date like other person has stated and yes its free. It has nothing to do with you moving to a new address. My wife and I received he same notice saying a potential waiver back in Feb. 2015 cause USCIS was backed up at least 6 months. We kept a eye on when they were processing the applications and when we seen that USCIS passed our processing date and we received no notice we called USCIS. The verified and seen that they did passed our processing date so they did a case inquiry. I think 9 days later we received a email that her green card was approved and to look out for the welcome letter. No interview at all.

So whenever the date your process your AOS if they have passed that date in the processing time frame then you should call and do a case inquiry. I tried to do a case inquiry for my wife online but it kept on giving me a error so i just called.

When you originally file for a EAD card it should of only taken 90 days to get your card. So thats why they tell you to file a renewal of the EAD work card at 90 days before it expires and it should take the same amount of time or sooner.

120 days is the earliest USCIS will accept applications for renewal AP and EADs, so that's when they should be filed - not 90 days.

I filed my renewal of EAD last August 14,2015. You think it's good? Coz it will expire on November 2015

You'll probably receive your renewal EAD before the current one expires, but it's possible you will lose work authorisation for a couple of weeks between your current document expiring and the new one arriving. In that case you would have to take an unpaid leave of absence from your employment so as not to work illegally which may cause problems.

Thanks for clarifying, I wish I had known this. We filed 90 days before and it took 83 days for approval, along with plenty of phone calls. I should have done it at 120 days, we were on pins and needles waiting. I never thought in a million years we would even need to renew it!

Thanks for the information. How do we find out what the processing date is? We were mailed a letter in March 2015 saying a potential waiver for interview. If six months have passed from the date of the letter and no green card we are to call them.

So when Sept 5th rolls around we should do an inquiry? What is the URL of the address as well?

It's definitely something people should bear in mind, particularly when adjusting from a K visa which, if designated as an interview-waiver, can take over a year to process.

Yes we are also finding this lack of a green card for One and a Half years is a big problem in other ways even though we have the EAD + AP.

1. To get Life Insurance/Disability Insurance, Companies want to either see a copy of the Green Card or for us to stipulate the Permenant Residence. Technically until approved, that is not the case.

2. The ID or Drivers License is only dated until the expiry of the EAD document.

3. Getting a loan/Line of Credit/Home Equity in both spouses name is a headache, since the banks want to know Immigration Status. It is a very difficult process to educate bank examiners on the process.

How do we find out what the processing date is?

So when Sept 5th rolls around we should do an inquiry?

Unfortunately USCIS does not publish I-485 processing times for the NBC (interview-waiver cases).

It would be fairly pointless to contact them after six months; the stated time period is not set in stone. All they will tell you is some variation of "your case is within normal processing times".

We got the NIPW letter mid-November and literally just got the card in the mail today. It can take a year +!
