Travel for PR that lost green card

Hello all! I will try and make this short. My husband a conditional LPR and I traveled to his home country of Costa Rica last week to have his old passport renewed.

While we were away, he had his wallet with all ID stolen, the only ID left was his passport. We had to make several trips to the US embassy abroad for a travel document to get him back into the USA. He received a sealed envelope that he will present at the POE.

Now the part that I am freaking out about. My husband had his passport renewed, because on April 25th my sister is getting married in the Bahamas. It will take 6 months minimum for him to receive his new permanent residency card, and advanced parole application is taking three months to process. I don't even know if the advanced parole would be valid as he is a CLPR.

Does anyone know if he will receive a stamp in his passport so that he can travel at POE.

If they can't stamp his passport at the POE, I would make an Infopass appointment at your local USCIS office and see if they could give you the stamp.

Thank you for the input! :) I did make a info pass appointment for Friday. I did some reading on the net, if what I am reading is true, several sites read "if you loose your card, you do not loose your status" and that we should be able to get a stamp. I hope so. Just when I thought I had at least a year of a break from the USCIS red tape, here we go againg! :o

UPDATE: So we had our info pass appointment, and were told that "no we won't stamp your passport". I advised the INS officer that I was told via THEIR info line that the passport could be stamped. If I had already had a receipt for payment of the lost card (I 90) a supervisor would have reviewed our case, and determined if HE/SHE thought we had a hardship case, if so, they WOULD stamp my DH passport.

Soooooo, we went home, submitted the I90 online, and made another info pass app for Monday. We were also told by the Newark INS officer to bring proof of my husband having his own business to prove hardship. WE advised her that he cannot get a copy drivers license replacement without he stamp, he is a contractor, drives everyday, she smiled and said "sorry, we cannot help you"

1. it is illegal to drive without a license

2. It is a misdemeanor to walk around without a green card

The USCIS is PROMOTING us to break the law! I really don't get it.. then I sat back and thought about it. If they gave us the stamp without proof of payment for the new card, why would I need to pay $260 for a new card, new biometrics, and another appointment at INS to pick it up? The stamp would be enough to work and travel. Soooooo I get it, but I would have preferred that they were honest, let me just pay whatever it is right here and now, stamp the passport,and let us get on with our lives. ha,ha,ha yeah right!!

It amazes me that while abroad, we showed a police report, one form of photo id, filled out a document at the consulate, and within 24 hours we had an official transportation letter to get my husband home. Now that we are back here, everything becomes difficult again. When the heck are they gonna get it right!

My husband went to the Mount Laurel office today for an info pass appointment. He did not have to prove hardship as they said in Newark on Friday, he did have to provide a copy of submission and payment for his new LPR card, and his passport was stamped. No Newark Drama!!

He is on his was to DMV to get his new license!@

Wow, I'm glad that the Mount Laurel office was more helpful!!

Just goes to show that the rules might be written down clearly but it still takes the human factor to screw it up and give us a hard time!

08/17/08: Mailed N400 to TSC

Glad it all worked out for you in the end! Sounds like you have had to filter through alot of problems! :blink:

Thanks! You know, when it comes to USCIS, there are always problems, and mistakes, huge mistakes. Each INS officer is able to "interprete the law" which is really scary!
