Filing Separate from Hubby... anyone?

I was just wondering if anyone has filed 'Married filing Separate', and not had issues/RFE from USCIS when it came time to submit copies as supporting documentation?

09-12-05 - AOS filed

04-21-06 - AOS Interview

04-27-06 - Approval

05-17-06 - Green Card in hand

02-11-08 - File to remove conditions

03-15-08 - Biometrics

03-18-09 - Approved - No interview (Card production ordered)

03-24-09 - 10-year card arrives!

What?

I'm curious about this too, they look at you differently if you file your taxes as "married filling separate"?

Feb 2005 - APPROVED for K1 Visa

June - 2005 - Moved to the USA =)

Apr - 2006 - APPROVED AOS Without Interview!!

Feb - 2008 - REMOVAL of conditions!!!!!

02/20/2008 - Package was sent to TSC.

02/25/2008 - Package confirmed received at TSC.

I've heard that they look at joint returns as a type of 'togetherness'. My problem is that my husband has bad debts, and I don't want to be penalized for this. These debts were created before we got married. For now, my only option is to file the 'Injured Spouse Allocation' form with our return.

i dont see why it would hurt if both returns are addressed to the same home. i know if i got more money back from filing seperatly i sure would do it. if they question u about it just tell them the truth.

My husband and I filed our first 2 return taxes as "married filing separately", since it was beneficial for us. This year, we will file "married filing jointly" since I had my full time employment last year and that moves up to higher tax bracket (ouch !). Therefore by filing jointly, we can take advantage for few deductions that are only available for this filing status.

We have not included our tax return as supporting documents when filing for I-751, but we have other documents that hopefully will be enough for the adjudication. Otherwise, if they ask for more proofs, we will just give them this year return tax, benefits statements from our employers that show each other as beneficiary, etc.

The worst case, they will require us for interview. ;) It won't be that bad.

Why would this be a problem if it is filled separately however both filled

with the same address??? I think if you did separetely is not going to be a problem...

if the the returns had different addressess...well that would be a problem..

For those who do not understand why it could be a problem to file "married filing separately": some/many people who file that way do so because they want to keep their finances very separate. It goes against the joint financial ties that USCIS likes to see. Your evidence is not just supposed to show that you both claim to live at the same address. Your evidence needs to show that you share a married life, which (IMHO) in USCIS's eyes seems to be largely composed of comingled finances.

I'm not saying it's automatically a problem to file separately, but it will probably get your application a second look. If you have a good reason for filing separately then IMO you should be fine. To me, good reasons are if you pay less tax as a couple that way, or like the OP who doesn't want to get entangled in her husband's bad debts.

i think u mis understood me. i said they should be addressed to the same house or there would be a problem...but its ok to file sepretly.
