Can my fiance apply for and use a tourist visa because she we won't get our K1 in time for our July wedding in Thailand. Meaning if and when I go over there to get married in July and we don't have our K1 visa yet...can she apply for the tourist visa in advance so that she can come back with me to America?

K-1's are for fiances of a us citizen, to get married in the US. They aren't for spouses.

K-1 visa issued: 12/15/2006

If you get married in Thailand, you need to apply for a K3 visa for her.

The K1 is to get married in the US - not in Thailand.

You can always apply for a toursit visa, but she probably wont get it with the K1 pending. When did you file the K1? Put up a timeline etc that would help! If you have a legal ceremony in the PI then the K1 is the incorrect visa for you, as someone said you need K3 or CR1. Even if you were to file the K1 now and didnt have an official ceremony in July, she would probably have her interview only a month or two after.

if you get married before you k1 visa(fiancee) is issued the k1 in process will be null and void. you will have to restart the entire process over again and reapply for a K3 visa(spouse)

I would suggest waiting on the wedding - especially if being together is the most important part. I know it sucks that you made all these wedding plans but they do say NOT to make any solid plans until you get your visa because the timelines are not definate and anything can happen (like being denied altogether).

I would start to see if there is anyway for you to put certain things on hold so you don't lose what ever money you put down on things. Unless of course the ceremony in Thailand isn't an official marriage (just for show so her parents and family are involved). If it is a legally binding marriage then you won't be able to bring her back on any other kind of visa than the K3.

I also think but am not positive, if you get the K1 visa you are required to marry in the United States.

Technically, she can apply for a tourist visa if she's planning on coming here to visit and then leave, whether she's married to you or not. But realistically, I think you're saying she'd be returning with you for good - so you're pretty much stuck. Also, the burden of proof you'd have to provide to show that, despite your being married, she wasn't going to stay in the US would be so astronomically high I doubt she'd get the tourist visa.

Alternatively, can you go ahead with the religious/family ceremony but refrain from legally marrying? If so, you can go ahead with your plans and still keep the K1 application alive.

But beware: you're going to have to be awfully clear and choosy with your words, making it very, very clear that you aren't legally married. Still refer to each other as fiances, etc....

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing
