Sent my I-130 to London USCIS office today

I'm first applying at the London office because I'm resident in the UK. I know they may not take it since I haven't receive indefinite leave to remain, but I've been living here for almost two years now. I've asked them to return it to me if they can't accept it so that I can forward it myself to Nebraska with a correct form of payment. I'll let everyone knows what happens.

Also I'd like to extend some encouragement to those in countries without a USCIS office. I hope DCF makes an official come back really soon.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

I'd really like to know what they say, especially since we in Denmark probably will have to apply in London and Denmark doesn't give permanent residency easily at all... It would take 7 years on temporary resident permits before you'd get a permanent one

Sadly there is no USCIS office in Denmark. Maybe there are some exceptions but USCIS offices typicaly only accept applications from petioners who reside in the country long term. So unless London has some exceptions to the policy your only option is to wait for DCF to come back and apply with the embassy in Denmark or file in the states. London may have juristiction over Denmark, but they would never accept an application from someone living in Denmark unless there's another policy change. And there has been speculation about such a policy change, but nothing on the way of official word.

I'm not sure about the London office, but I live in Spain and since the Rome USCIS office has jurisdiction over Spain, they said if I am able to prove residency in Spain, I can apply in Rome. Check the website. Oops I just remembered a guy from Ireland told me that London would only accept UK visa applications. I would call and double check.

UPDATE - They've charged our credit card! Which means they consider it to fall in their jurisdiction. Hopefully it won't take too long for the NOA1 postcard to arrive and then I'll really believe it's happening. :)

So for anyone living in the UK with their UK spouse, it definitely looks best to attempt to file at the London USCIS first if you've been in the UK for a while on a non-visitor visa. There's a great forum at www.diveintoamerica.com. Everyone there has found that if you've been in the UK for 11 months or more, they tend to process your petition, which has turned out to be true in my case. :)
