With the confusion Here is my plan

Hello Everyone, After a very sleepless night, If you have been reading my post, you will see that 1. I was giving wrong information from the start by USCIS. 2. Sent the wrong petition in. They have sent me NOA-1 and I have check my bank the check has been cashed. Now after sitting thinking of what to do I have can to this conclusion.

I will send the I-130, also included I-129F will all the copies again. Also including a copy of NOA, with a letter explain they mix-up of information that I was given, (lucky I have the persons name and ID) at USCIS and like they say so are recorded. So this might help.

When I called the person explained, after pulling my file up that my I-129F shows that this is for spouse, and I should send the I-130 in so this can be approved.

Does anyone one have input or opinion to this?

I'm afraid that this could delay every considerablly

I personally would NOT send in anything related to the I129F with the I130.

I would file the I130 normally, and then once I got the NOA1 for the I130 I would deal with the I129F. But the most important thing you should be focused on is getting the I130 filed properly, otherwise you can't do anything.

I feel like if you try to send everything in know it will just confuse the filing process for your I130.

12/14/06 - case number assigned

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

They're going to send you an RFE anyway because the I-129F doesn't have the NOA from the I-130. So, just send in the I-130 and supporting docs required, and wait for them to send the RFE so you can send the copy of the NOA.

If you send anything *before* they send an RFE, the likelihood that it will actually get matched up with your file is next to nil, and if you send any I-129F info with the I-130, you'll just confuse them.

Thank you to all here at the vj. I am going to wait till I recieve the REF. I don't want to start any confusion. The information that USCIS gave in they first place was not correct. As I see here everyone has been through or is going through so you know the process and what some of the pitfalls that could happen. So I consider the information that I get here at vj more accurate at this time.

I have I-130 ready to send, and if further REF is need I have copies of this.

But thank you so much everyone for you suggestions.. I will wait to get a notice before sending it.
