Ok I need some help I came over here the USA from England on the visitors visa, got married on that and then didnt leave. We have been married for three years and talked to numerous lawyers which have become too expensive. So needless to say i am technically illegal. We have three kids together, now i need to know what to do and what forms We can fill out on our own to get this done properly. Can someone please help? :help:

Were you able to receive any help from the lawyers? This forum is really only best for cases without serious complications like yours. If you provide some more information - like did you intend to marry when you entered on the visitor's visa? have you attempted to file anything? - we could speculate and try to provide places online for you to go to for info, but an immigration lawyer is really what you need.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Follow that guide. Get the forms filled out and then mail thm in, so your process is started.

02/09/2005-------Sent in request to Congressional office for assistance with expediting EAD.

02/13/2007 -------- EAD Approved!

02/26/2007 - ------EAD received

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Hi Mikki2k6,

Good luck on your immigration journey. Likewise, I came over for a visit to the USA (from Canada), got married and didn't leave (lol..who knew that a short visit would end up being a lifetime here). Anyways, on the advice of a lawyer, I filed for an AOS, and got my Green Card shortly afterwards. By the way, I think that there might be a time limit as to how long one can be "illegal" here in the USA....

My thoughts for you (and for everyone else, no matter what the situation) is to hire a lawyer. Shop around, and see if you can get free consultations and/or discounted case fees too. Feel free to PM me too, if you need more information on the lawyer that we hired for our case. Hope this helps.

The link you were given for the forms is the way to go.... as the spouse of a USC any overstay is forgiven at AOS interview... dont bother applying for the Advanced Parole that allows for travel as you should not leave the US until you have your Greencard ...

As soon as you have got the NOA1 for your AOS you are no longer Out of Status you then become Adjustment Pending... I did it without a lawyer and had no major problems, but I did have a consultation with a lawyer just to make sure that what we were doing was not going to cause us any major issues in the future...

I've always wanted to ask this question, and I know everyone's situation is different, but how does one just 'not go back'? Perhaps it's a factor of age and how much someone is settled in their country, but aren't there bills, taxes, bank accounts, personal possessions, etc. that would need to be taken care of before someone just leaves their home country? I don't mean to pry, but I never understood how this can happen....

In my situation, I had to get my family to take care of sorting everything out for me, including selling my home and retrieving my car from the long term parking at Glasgow airport, all bills were paid on line after the final bills were sent to my parents house, I had to give my mum power of attorney so she could deal with things on my behalf... not an easy way to do thing but with their help I was able to sort everything out from here...

Hi JenT,

Good luck on your immigration journey. In answer to your question, in my situation, I just dealt with it after I got the immigration stuff taken care of (getting the Green Card, so I could travel back to "tie up any loose ends"). It only took me one trip back over the border less than 24 hrs to deal with everything, such as picking up possessions and closing up bank accounts. The rest of the stuff I took care of through phone calls, paperwork, having someone collect and forward the mail, etc. After all, if there is nothing to go back to, then why bother going back? And yes, this can happen, life changes, why not change for the better in the USA?...
