thnx alot everyone especially automnal for that long concise post!

We have everything USCIS might need of us.. We have hundreds of pix (we didnt have a wedding bcz i wanted the $ to go towards our nice house. To compensate also, My husband said we'll do a renewal of vows in Canada so i can have my family with us)..

My signature appears in the house documents also, i'm the beneficiary of his 401k. We have his tax records stating we filed jointly. We have cards from family to congratulate us. I have a card i sent him when i was in Canada few mths ago visiting my family. He paid off my student loan. I still have my return ticket. Cards from his mother/family calling me their inlaw..Pix of our car trips together to different states.. Valentine's cards..

I too got married on a VWP I was not even asked at my interview about my intentions when I entered the country.... I did my medical before we got married in fact 6 weeks before... We just forgot to send it with the application... I arrived in Feb 2005 and we got married in April 2005... I had no issues about the medical...

We showed all the usual proof of relationship and joint living and our interview was good....

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
19 July 2005 - NOA 1: I-130 received!
24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!

01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.

Your choice to marry and adjust after entering the U.S. on the VWP brings with it a greater scrutiny during the AOS. The upside was that you were able to stay together rather than being separated during a visa application process. The downside is the increased scrutiny at the AOS interview and the fact that you may not appeal if you are denied.

Noone here can predict what will happen at your interview. An attorney can help you prepare your best case for the interview, but can't guarantee an approval.

Your case is what it is and will stand or fall on it's merits. The adjudicator will make his decision based on the documents he has before him and your answers to his questions. Some of his questions may very well arise from sumitted documents and concerns he has regarding timing and dates.

Not sure OP is under VWP (visa wavier program). Canada isn't even on the list of countries that do the VWP.

The medical was done in 2004 -- is it still valid having been done over a year ago?

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

i should also mention, my husband also came here as a visitor from Canada ((let me clarify: with only his provincial ID card as Canadians do not need passport OR visa to enter the U.S. this was in 2003)).

We had known each other for 6 years and after he entered as a visitor...5 days later we decided to get married. 5? maybe 7, i can't honestly remember. I could look it up, but anyway. Personally, I don't think you should worry too much. IF asked about it ((you may not be and certainly don't bring it up yourself)) just explain it llike you have, just tell the truth. I can't guarantee anything, but that's my opinion.

I know we will not have a problen proving he did not come her with the intentions of getting married and adjusting status because we actually left to Canada after we were married. :blush:

My understanding about the medical is that it has to be under 1 year old when you file for AOS.... if this is not the case them many many more people whould need to have a new medical just before interview as alot of people have waited more than 12 months for interview.....

I agree with you. When we went to our district office the officer gave us the paperwork and said to wait for USCIS to send an RFE (request) for the medical because they're only valid for 12 months and waiting for them to ask for it before doing it would give it more of a chance to be current at the time of the interview request. :yes:

Not sure why they would tell someone to do the medical first. But...there is a lot of misinformation floating around from USCIS. I have learned to ask multiple officers/csrs the same question because you'd be surprised at how many different answers you get! :blink:

Yup, stop worryng :) *hugs*

I'm a VWP entrant from the UK, and we decided to get married and adjust blah blah after the London bombings...we weren't even engaged when I came here last May.

All they want is to have had a chance to inspect you at the border - a chnce to take you aside, stamp your passport etc. If you entered legally, they had this chance! That's what they want - if you skipped the border on the other hand, you've got problems :P

You're from Canada as well - I'm from the UK. Neither one of us had any economic reason to want to come here - in fact as far as I know, the UK's economy is far more stable than the US's. So that makes THAT form of fraud less "suspicious" to them - it really does...sad but true!

Lastly, I wouldn't worry about the quickness of getting married or your medical, because you know what - they would have to have SEVERE reasons to kick you out - not JUST a vague hint of suspiscion that you'd entered to stay. I kid you not.

Don't be losing weight and fretting - we have our interview on the 29th - just do as Autumnal was saying, gather lots of lovely evidence of your love, and try not to pass out in the interview room! :) :)

Feb 2009 - Called USCIS to see what the heck was goin' on...

FEB 20th 2009 - Received email - GC on the way!

I am APPROVED for the 10 year PR Card!

I'm no expert, but I have a paper here that says they expire in 12 months. HOWEVER, if they didn't send an RFE for one...I'm guessing it's fine.
