I see. So for my wife(petitioner), if her monthly salary x 12 (months) would exceed the poverty line, we would not need a joint sponsor right? If that is the case, we'll just send her IRS transcript, last year's W2 even if it's not required, 6 months of paystubs just to be sure, and letter of employment. That would be sufficient enough correct?

That is all correct. Regarding your other question, the amount of money on the poverty guideline is the annual salary before deduction of taxes.

Hi All, just want to ask the following especially to those who have finished their AOS and IV packages :)

We will be sending my wife's paystubs for proof of income, does it have to be original or a photocopy would do?

Regarding the federal income tax return requirement, is that the form 1040?

In the checklist, a proof of relationship (Financial documents part) and marriage certificate (Supporting documents part) is needed, what's the difference between the 2? Should the proof of relationship be pictures, etc, or can we just use 2 marriage certificates (1 for aos package and 1 for IV package)?

What is 'petitioner documents' in the checklist?

-A photocopy is fine.

-Marriage certificate is only sent once in the supporting documents, but you don't lose anything by sending it twice.

My wife started working per diem Aug 2013 and that's what we indicated in the I-130. Right now we're gathering docs for AOS and that includes the employment letter. Her employer indicated there she started May 2014 since that's when she got transferred to the department where she worked more hours (like 3-5x a week for 8hours). Would that be a problem in NVC? Do we have to put an explanation in the AOS package?

In the i-864EZ form, part 5 to be specific, there are fields there for the 3 most recent income tax returns, does that mean it is required for the petitioner to be working for 3 years? Do we just leave the other fields blank if she only worked for a year? If we leave it blank, do we have to provide an explanation for that as well?

i've just finished my case complete in nvc, gone through almost similar condition in AOS,

The docs we submitted

1. i864 for my wife,

2. I864A for her father (living in same address)

3. I864A for her mother (living in same address)

and other supporting documents for proving the income,

so far no issues with the forms i've submitted, but got a checklist for a signature that is missing in one of the forms, (i've the xerox of all the docs sent to nvc, in that version sign is present, may be it got erased while posting :ranting: )

How many days

it takes when you got completed when you submit again documents..same situation coz my husband forgot to sign in his i-864..

If your wife makes enough income this year(current yearly gross income) then you do not need a joint sponsor. Current income is what matters most. Previous tax records helps to establish steady income and that the person has been filing taxes if they are required to.current income will be diffrent then what is shown on w-2s It is the amount you are expected to make for the year. For most people using the formula - pay per hour x average hours work per (it is 40 hours for most) x 52 weeks on a year =current income

If you use just your wife income. You can use the I-864ez form send in proof of current income such as pay check stubs and or employment income letter.It is easier if you send in tax transcripts with the I-864ez. W-2s are not needed then

If you send in copies of the 1040 forms then copies of w-2s are required.

Also on the tax questions make sure to put right amount. If your wife file taxes using form 1040 or 1040A then total gross income is used. If she file taxes using 1040ez then adjusted gross income is use

Do not leave blank put 0 for any year she did not work and file taxes. Send in explanation why she did not have to file taxes for the year she did not file

yes 1040 1040a 1040ez are the tax forms

proof of relationship for the I-864 is for sponsor relationship to household member if the house member income is also use

petitioner documents for IV packets is the petitioner birth certificate if you are applying for a IR5(parent of U.S citizen) or a F4(brother or sister of U.S citizen)
