If it so happens that my wife gives birth to our child after CASE COMPLETE before INTERVIEW what happens and what are we supposed to do? What is she gives birth AFTER INTERVIEW and VISA has been issued? what can we do? What will be affected? I am the petitioner in the US and she is the beneficiary outside the US

I hope you are having a great day! This case is similar to my friend. The baby was born after the interview and her visa was issued already, she left her home country and petitioned the child later on. I think it will be best if you post this question here: https://www.avvo.com/

Personally, I always use that site for important and urgent legal matters. Lawyers who are knowledgeable of immigration laws would be able to help you better. It would be best to contact an immigration lawyer and see what else you can do.

I think the child be issued visa under the "follow- to- join" bases but i will advise you consult with an attorney over there in the US regarding this.

my thoughts exactly! knowing that F2A petition would take two years, not sure if I can leave my newborn behind and not see his newborn milestones. I think ha, for this case, call a lawyer soon, maybe there is a way to add your baby. Oh, congratulations! you must be very excited to see them already. Best wishes!

I havent seen the baby....wife is about a month pregnant now......8 more months and my PD is July 09, 2015. My calculations indicate that the visa may be issues almost at the same time child is born or shortly after. I close my fingers. I have already submitted all required docs and paid all fees to NVC waiting for CASE COMPLETE

Hi, any other July filers without WL yet? Our PD is July 29, 2015 and it seems that we're the only July left without WL. I'm getting anxious about it. Called NVC 3 days straight and I kept getting the "you should get it 6 weeks after June 15".

Hey, same here. My wife's PD is July 08, 2015 and we still didn't receive a WL. We moved in a new apartment and send the new address to NVC but didn't receive a confirmation so I'll call NVC today for more informations

The U.S. Department of State (DOS) is the agency that allocates immigrant visas. In general, family-sponsored preference visas are limited to 226,000 visas per year and employment-based preference visas are limited to 140,000 visas per year. (By statute, these annual visa limits may be exceeded when certain immigrant visas from the previous fiscal year’s allocation were not fully used.) Both categories are further divided into several sub-categories, each of which receives a certain percentage of the overall visa numbers as prescribed by law. In addition, there are limits to the percentage of visas that can be allotted based on an immigrant’s country of chargeability (usually the country of birth).

When the demand is higher than the supply of visas for a given year in any given category or country, a visa queue (waiting list or backlog) forms. To distribute the visas among all preference categories, DOS allocates the visas according to a prospective immigrant’s preference category, country of chargeability, and priority date. The priority date is used to determine an immigrant’s place in the visa queue.
