August 2015 K-1 Filers [merged topics]

CONGRATS to everyone receiving their NOA2s and case numbers!!

I'm still waiting on my NOA2, but I am slowly starting to gather the documents I need for my affidavit of support (for when that time comes).

Questions:

Is the employment letter mandatory?

And, if I have more than one job, do I have to get a letter from each job?

Also, for the tax transcript, I noticed that on the website you could request either 'account transcript' or 'return transcript'. Which one do they prefer?

Finally, if I can show that I exceed the poverty line with my tax documents, do I still need to submit bank statements?

Right when I read your comment, I was on hold for the first time waiting to see if we got our yet and we haven't. I was wondering when you call nvc, do they make it seem like they haven't received anything yet or give you any update because it kind of nerve wracking talking to them about it. It makes me feel like my case is lost somewhere or still in California. Just wanted to know if this is their typical response that it takes 35 days for them to receive it and then say goodbye.

Our NOA2 date is August 27 and when checking K1 processing times it says that they're processing NOA2s from August 25 right now... so we got ours a little bit early I guess. :)

Keep in mind that if your application for the visa is approved you have 1 year to process the visa at your Embassy. If it goes beyond that date, it will be considered abandon and if you beyond the anniversary and want still go forward, you'll have to resubmit another application and fee.

I was under the impression that we only have 4 months from the NOA2 date to have the interview.

My NOA2 was 8/25/15 and I recall that there was another date (perhaps labeled "expiration") that was 12/25/15.

Is it truly 1 year and not 4 months?

I believe the employment letter is mandatory, especially if you're 125% above the poverty line and don't submit bank statements or such (which you don't have to if you exceed the poverty line). And if you have two jobs, I would get an employment letter from both jobs since those are some of your documentation (along with the tax transcript) for being above the poverty line.

From what I can read on here, most people are recommending getting the return transcript as it contains the most information.

"Definitions:

A tax return transcript shows most line items from your tax return (Form 1040, 1040A or 1040EZ) as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes you, your representative or the IRS made after the return was filed. In many cases, a return transcript will meet the requirements of lending institutions such as those offering mortgages and for applying for student loans.

A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income. "

We're aware of that, thank you for the reminder though. Our petition was approved August 27th and we plan to go to the Interview very early in July. That should give us around 2 months to obtain the visa after the interview.

Quick question though, would the visa still be valid for 6 minths after the medical exam or would it expire August 27th 2016 because that's when the approval expires? Because if thats the case, then maybe we have to consider withdrawing our application and submit it again sometime next year.

From what I've understood the clock resets from having your medical done - meaning no matter the time it took for you to get to that stage of the visa journey, you'll have 6 months regardless from the date of your medical exam.

A completed I-134 Affidavit of Support Form for the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2) for 2014. Employment letters stating salaries and bank statements may be included to substantiate the I-134.

Each Embassy is different so I invite you to visit your Embassy's website where you will find the list of required documents to prove that you can be financially responsible for your beneficiary.

If you are above the poverty level then you will not have a problem for this question as it may never come up as your income will satisfy the CO that you can support the beneficiary.

The clock begins with the medical completion and may or may not be 6 months in length because it all depends on your medical. If you complete the medical with no problems then yes you'll have 6 months. But, if you have complications requiring further testing then it can be shorten. For example some in The Philippines are diagnosed with TB and once they complete the test/cure regiment (which can take upwards of 4 months), they find they have anywhere from 2 months to 2 weeks. Not to long ago one such young lady had only 2 weeks to be on US soil. She rushed with tying up her life there in the Phil to get on the plane for USA all in 2 weeks.

Haha same here.

Petition is only valid for 4 months. And once you have the medical done you have 6 months from that date.

That is how i understood it.

I'm not the only person still waiting for NOA2 right? They received it on the 19th, and I got NOA1 email on the 24th but the status on their site is still only up to received. I know I just gotta be patient but it's frustrating seeing other people who have receipt dates of early September start getting approvals already...

Nope, not the only one. Our Noa1 is 25th august. Im still checking the app every 10 minutes.
