August 2015 K-1 Filers [merged topics]

We received and RFE for not indicating that we met online on Lucky Lovers. The RapidVisa consultant advised me not to put it in my "how we met" statement. Did anyone else meet their fiancé online? And if so what did you write in your statement about how you met? The RFE is asking us to show that if we met online the website is not a International Marriage Broker. Technically it is if you read their definition of it. Just wanted to know what someone who's actually been approved did.

We met on Facebook which we also wrote in the "how we met" section, we didn't go into details about what Facebook is as we kinda assumed everybody knows the social media site.

I've heard of others getting RFE's having to provide info on the site they met on - about it not being an International Marriage Broker site. Usually people send off the "about this" site / forum / page to prove it's not the above-mentioned.

But you're saying the website you guys met on is in fact such a site? If so, you would have had to state so on the I-129F itself and I honestly don't know what kind of consequences it will have having met on such a site (I haven't looked into it since it didn't apply to us). I just know it's not good if you stated otherwise and it ACTUALLY is an International Marriage Broker website...

The problem with doing a visa for the first time, and that you hired an "expert" the expert didn't turn out to be much of an expert, is you don't know. So your thinking, hey they should know this stuff it's their business. Sorry, I just don't see the need for a lawyer or a "agent" to help you with this. Rapid Visa should always advocate that you supply truthful information and they should know what to do to satisfy UCIS. They let you down.

Next write a letter to include with the TOS that states that you met on line at Lucky Lovers and that you are not entering into a IMB marriage and that each of you are marrying the other of your own free will. Both of you sign the letter and enclose into an envelope with the RFE and follow the return instructions as outlined on the RFE. Keep a copy of EVERYTHING you return to UCIS. Be sure to include on your letter all required reference numbers. Again, follow the RFE.

This discussion has just made me realize that I might also get an RFE on the IMB subject. I also met my fiancee online through a dating website similar to tinder or Okcupid. I read the definition of IMB before sending my K1 application to USCIS and it appeared obvious to me at the time that the website I used was not an IMB. The question I have is: Would meeting somebody through a dating website where there is no broker involved but just two individuals who created profiles in the site and met through the site be considered an IMB? My understanding of IMB was an active matchmaking process where an organization/individual makes the introduction of the two individuals, collects personal information including pictures of one individual and gives them to the other person for a fee. Am I correct?

My NOA2 is taking a little longer to arrive. I am getting a bit concerned. My NOA1 date is August 17 and according to VJ timeline, I should have received my NOA2 last week. I guess, I will see if I get an approval or RFE hopefully by next week.

Thanks for the replies. And thank you GreenBaum for the suggestion. I was on their site earlier and I was looking at the Terms of Service. I actually reached out to LuckyLovers and asked them to provide me a letter stating they're not an IMBRA. This is my first time filling out the visa (under the supervision of of RapidVisa of course) so I guess it's trial and error. I posted this to get possible solutions and so that others can avoid the same issues and not receive and RFE. I'll let you all know the outcome.

What did you state in your petition?

I stated we physically met at Odessa airport on such and such date( again under the direction of RapidVisa). Keep in mind folks, I'm not slamming RapidVisa and their services. They've been very helpful up until this point and have always been very prompt with answering emails and questions. I think the advisor's intentions was to have me avoid the IMBRA issue by not addressing it. Obviously the UCSIS wants details like that. I'm sure we're not the only couple to meet online and file a K1.

Some of the websites that you meet on are familiar to USCIS, the one that stands out is Facebook. But, some of the others they have no idea and so for them, they just issue a RFE and now it is your responsibility to do the research and provide them with documentation that it is not an IMB site. The best way to answer is to print off the terms of service (TOS) and return it with a cover letter from the two of you that you are entering into your marriage at your own free will and no fees have ever been exchanged with anyone or any company and one did not arrange for your union.

I should add that I mentioned where I met my fiancee on the K1 application.

Yes, it's a requirement to provide the necessary information, albeit truthful, to any application or form that is used during your visa processing.

I sometime get critical of a company that has made a mistake that has cause a delay in the processing for the application. But, having said that, they should know not to skip something that is asked on a form. I'm glad you are satisfied with their services. You may have gotten a "new" person who though that it didn't make that much difference if you were to skip over that question.

Congrats to everyone who has gotten their NOA 2 recently! My fianceé and I both just got a notification from the USCIS status checker phone app that our status updated today, which is weird since it's Sunday and we've gotten our approval more than 2 weeks ago already. And nothing on the website changed. Odd...

Anyway, sadly our plans changed quite a bit again and it looks like I won't be going over to the U.S. until the Xmas season of 2016. Our NOA 2 expires December 27th this year, so hopefully I should be fine if I attend the interview sometime in June / July 2016.

I believe that's the deadline for having the medical exam / visa interview done?

From what I've heard the 6 months of validity kicks in from when the beneficiary has had his/her medical done.

I'm not sure if it's possible to extend your medical exam and interview by THAT many months?

They give you that date for you to have your interview completed by. You can extend your application up to a year from filing. They like to keep things moving so they give you a valid date.

Most get the interview completed in the time span (4 months). If you have something that prevents you from meeting that deadline, like I said you can extend it by calling the Embassy.

You can extend your interview date, as long as you have not taken your medical exam.

If nothing was found during the medical exam that would delay you, then you six months to interview and to be on USA soil.

The clock started ticking when you have your medical exam. Six months to be on USA soil.

If you have not completed your medical exam then you can extend your NOA2 date for interviewing. Up to a year, otherwise you have to start this process all over again including paying the fees.
