August 2015 K-1 Filers [merged topics]

Hi all!

A few questions about the AOS status for those of you going through it right now. For those who have interviews scheduled and/or received your green card, how long did it take for them from the date you sent it? We sent ours in mid-February and still nothing :(

We can't find our EAD number, so if anyone also filed for EAD around mid-February, could you let me know how quickly yours is moving along? Also, we got an RFE for the AOS, but it was just about our financial records - so that won't affect how quickly the EAD moves along, right?

Last thing...my husband's driver's license expired the same day his I-94 did! How do we get him a new license? We can't possibly wait until the green card arrives for him to be able to drive again.

Hey all. Sooo i was just wondering how long you all waited from filing AOS for your NOA1?

I'm a bit concerned as we filed April 16th. The cheque has been cashed but no NOA1. We forgot to put in the form for email notification but that shouldn't affect receiving the NOA.

My AOS packet was received on March 27, got the email and text notifications on April 4 and the hardcopies arrived in the mail on April 9 :)

I'm in the April Filers group and a lot of people that filed start April to mid April are having a slow process at the moment so don't be concerned. If your check has been cashed you should be good! Are you in our April group? If not, you should definitely join!

Hello :) I'm still awaiting my EAD card (had my Biometrics app. on the 26th of April) so I can't help you with the interview / Green Card questions just yet. According to my estimated timeline I should get my EAD around May 30th - June 5th

When did you have your Biometrics appointment? You filed mid February - you haven't received your EAD card yet? I can't see why the RFE for the AOS would affect your EAD application - they should be separate.

In regards to the license, you'll have to wait for the EAD card and then you can go back and renew / get a new license for him.

Glad to see so many of you are already living with your husbands and wives! :)

I think we might be the very last couple from the August filers who still didn't go to the interview yet lol. It's coming up very soon though! I'm about to send the consulate all the required documents so we can schedule our appointment. Apparently the wait is 6-8 weeks to get an appointment which is perfect because that's when my fiancée will be with me in Germany. Hopefully I can finally move to the US just before Thanksgiving.

Plus we have been notified that Green Card interview date is being set. We just don't know when yet.

Your AOS RFE should not affect EAD. I don't think.

My fiance's flight is today :) I'm so excited! In about 24 hours I'll be picking him up in Dallas.

Is the only form he needs to fill out the Customs form? Is the I-94 automatically generated now? I'm confused as I can still pull up this form from the customs site.

Just want to make sure that my fiance won't have any forms to fill that I didn't already translate and "fill out" for him.

I've been reading POE reviews and it sounds super easy, but can anyone comment how easy/difficult it is not really understanding much English?

I'm assuming there is wifi in the immigration are so he can talk to me through whatsapp, but still he is nervous.

Yay!! Good luck to your fiancé :) POE was pretty easy. I didn't have to fill out the customs form, just make sure he gets the stamp in his passport !! The I-94 is electronic now yes.

When he goes through customs he just have to state he's here on a K1 visa, show his passport and sealed envelope. I was taken to the back where I was asked a few questions and that was it.

I was really nervous too but I'm sure he will do just fine !

Good luck! It's a very common procedure for the customs officials... All will be well. Interpreters are found if language is a barrier.

Mine took a while - sitting and waiting to be asked a few questions - but it was easy and smooth. Just very slow as a lot of people ahead of me.

Only moment of concern was as I tried to exit with lots of bags and a bike... until I explained to the official the visa I was on - and he grinned and just waved me thru with my mountain of stuff.

The sealed envelope! I had forgotten about that. I had guarded it nervously for weeks. And all the way from London to Frankfurt to Las Vegas... eventually handing it over as if it were some priceless artifact... The customs official just grabbed it from me and roughly ripped it open in the blink of an eye. I nearly lost my lunch.

G'day there,

Filed AOS, EAD and AP on 7 March, received NOA for each on 16 March. Biometrics appointment 11 April and EAD and AP were approved 3 May, card received 9 May.

So... based on what you have mentioned above, the RFE may have slowed things down a little :(( ... Logically speaking it would. If the financial part of the AOS is not in order it could be deemed that you could not support your husband, so EAD would be on hold until that was cleared.

With reference to the driver's license, I had the exact same thing happen to me, I wasn't told when I got mine that it would only be good for 3 weeks, was NOT happy when I finally got the license in the mail to find I was only legal for another 9 days.

I'm in Texas and I found that I was able to submit my I-94 and the latest AOS (i-145) NOA (I-797). The licensing authority then submit a request to SAVE who will verify your "Lawful Presence", sometimes immediately, others it takes time, depends on your records. Once lawful presence was verified I was able to get my new license, valid for approx 1 year.
