hey if I call the USCIS customer service, do I ask for Tier 2 officer? I just spoke to someone on the customer service and she only asked for receipt number, and checked the status for me which i can see for myself on the website. She did not ask further for birthday, address etc. I even asked what address she has on the system <since i recently moved and updated my new address previously> she told me she cannot give any personal information over the phone. I can only do that through local USCIS office... sigh

How did you end up talking to Tier 2 officer? can I ask for it?

I had actually called them for two reasons. One of course my concern about the case taking so long and second was that I had changed address after filing the request and I wanted to make sure that they had the correct address. When I spoke to the first person who was a very sweet lady, she gave me same information that the case was still within the standard processing times and that she could not provide me any more information, nor could tell me about my address on file as they cannot discuss it over the phone. I stated that I had received a letter from USCIS about my changed of address request. She asked me to read it to her and I did. She herself determined that it was beyond her jurisdiction so she kindly offered to transfer the call to a Tier 2 Immigration Officer. The waiting time was 59 minutes and I was offered by the automated voice service to schedule a call back. I did receive a call next day from a Tier 2 Officer who was able to verify that they had my updated address and also told me that my case has been approved.

So ... Yes you can ask for an Immigration Officer or a Tier 2, just be polite about it though. The people we get to speak to are just the Customer Service people with little to no access to the case files.

My husband's an early Aug. VSC filer. We actually mailed it in July. He filed for natz on the very first eligible day, and his biometrics are tomorrow. I keep checking the website to see if ROC will be approved before. We spoke with a local immigration lawyer who said Boston will likely adjudicate both the I-751 and natz on the same day, and here in Boston its about a month between biometrics and the natz appointment. What a waste of money and energy for a 10 year green card that will very shortly become pointless.

That lawyer was not correct. I also filed for naturalization while my ROC was pending and my ROC was approved shortly after I sent my N400 package. So you may also get approved and receive your new card before you have your n400 interview.

Your timing is little off though, biometrics and n400 interview is currently about two months apart in Boston. If your bio appointment is tomorrow, your interview will most likely be scheduled around august 10-15. Good luck!

Ok, thanks for sharing your experience. But how can you say the lawyer is incorrect if she and her firm see clients all day long? They have more points of data to analyze than your one experience. Either way, I will keep the forum updated.

I objected to the assumption that lawyer makes for the concurrent interview. If it is a CSC case that has been pending for 10 months, that's a different story. CSC cases do not wait this long unless there is a background check issue or the case really needs an interview. VSC on the other hand makes everybody wait too long. That's why I think you guys will also get approved before your N400 interview. However, for whatever reason, if you are not approved before the N400 interview, I'd prepare for a concurrent roc-n400 interview as the lawyer predicts.

The attorney said she has had clients in the last month, all of whom filed through VSC because we are in Boston, who had concurrent I-751/natz with no RFE. I don't see how its an assumption. Regardless, what will happen will happen. We can debate but that won't make anything move faster. It would be wonderful for the I-751 to be approved before the natz interview in the next month or two.

So you can technically apply for naturalization even if you have a case pending with the USCIS?

Yes you can apply when eligible! That would force them (USCIS) to adjudicate any pending case(s) before processing the N-400 Application for Naturalization!
