Help

Here is the situation.

My wife has a Brazilian friend that has lived in the United States for the past 6 years. She is married and her husband never did file the papers for her to get her Green Card. As I mentioned, she has been in the United States for 6 years and now she would like to know what does she have to do in order to get her proper documents. She does not have a work authorization card or anything.

Is she officially illegal and what can she do in order to get her proper documents? By the way, don't say go to the Brazilian Consulate, they are not helpful to other Brazilians.

I need help, not just what you think.

She is Brazilian that is why she may have needed to go to the Brazilian Consulate for help, but they are not too helpful.

She also came into the U.S. on a fiancee visa. She got married but they never did file for legal residence papers. She lives in Chicago and really needs help. Her husband is non-chalant and really does not care about her future. They also have a 6 year old son together.

Her husband is a US citizen.

We are talking about US immigration here - the Brazilian consulate would not be of any help because they are not a US consulate.

If she is married to the person who petitioned for her K1, they have to file her AOS papers.

If she is married to someone else, whole different story. She would have to return home and start from the beginning.

She should start with a consult with a qualified immigration attorney like Laurel Scott www.visacentral.net.
