Hi all,

I'm getting married to an amazing girl in March and currently I am on an F-1 Visa.

I will apply for AOS once married and right now I'm plowing through all the information about it.

One thing that kept poping up as I read through the search results for student visas was that you shouldn't enter the

U.S using an F-1 if you have intent of immigration.

Not sure how this relates to me and returning from my honeymoon.

Can anyone shed some light on the situation? :yes:

AOS Timeline:

7/928 2008 - Mailed packet (I-130, I-485 & I-765)

7/31 2008 - Packet arrives at the Chicago lockbox

8/07 2008 - Checks cashed

8/08 2008 - NOA Received (I-130 & I-485)

8/08 2008 - Application Rejection Letter received for I-765 (Outdated form that expires 08/31/08!!!)

8/11 2008 - Biometrics Notification for August 28th

8/14 2008 - New I-765 received by V. Bustamente

8/18 2008 - Tried a walk-in Biometrics but office closed(!!)

8/19 2008 - CRIS email. RFE #1

8/23 2008 - RFE Letter. Birth Certificate (wth?!?)

9/09 2008 - NOA for I-765 received

9/12 2008 - EAD Biometrics notice for 9/29

9/16 2008 - CRIS email. RFE received on 9/11 and case resumed.

9/26 2008 - EAD Biometrics completed and touched online.

11/07 2008 - EAD Card production ordered.

11/08 2008 - Interview Notice for December 09th.

11/20 2008 - EAD arrived in mailbox and work resumed.

12/09 2008 - Interview. AOS approved and card production ordered.

12/10 2008 - AOS Touched.

12/12 2008 - AOS Touched again.

12/15 2008 - AOS Touched a third time (which usually means the card is in the mail! Hurray!)

I am also adjusting from F1 to permanent resident (married to USC). I don't think it's a problem, as long as you can show proof of a bonafide marriage. I came in 2001 on an F1, met my husband while a sophomore in college, and got married almost year after graduating. I think as long as enough time has passed between the time you entered on an F1 to marriage and AOS, you should be fine. Good luck.

06/23/10...Interview appointment - PASSED!

08/19/10...Oath ceremony - Officially a US citizen!!!

08/31/10...Applied for US Passport and Card

09/15/10...Received US Passport and Card

I -751 Removal of conditions

04/04/09...I-751 sent to California service center

04/12/09...NOA1. permanent residence extended for one year.

06/10/09...Biometrics appointment done

06/21/09...2 yr GC expired

07/09/09...Approval letter received in the mail!!! GC approved 07/06/09

07/20/09...10 yr GC arrived in the mail.

AOS/EAD timeline: F1 to AOS (married to USC)

11/14/06.....I-130/I-485/I-765 sent to Chicago Lockbox (Day1)

11/21/06......Checks cashed, NOA1 for I-130/I-1485/EAD arrives in mail (Day 8)

12/12/06.... Biometrics done (Day 29)

01/20/07...Interview notice received dated Jan. 12, Yay!! (Day 68)

01/30/07....EAD touched, finally!(Day 78)

02/01/07....I-485, I-130 touched. EAD card production ordered (Day 80)

02/07/07....EAD card received in mail (Day 86)

02/26/07...Interview - name check pending (Day 105)

06/21/07.... Card production ordered email...omigosh! (Day 220)

06/24/07.....Email: Notice mailed welcoming new permanent resident on 6/22

06/30/07.....Welcome notice received in snail mail

07/02/07....Email: Approval notice sent. GC received in mail!!! (232 days from filing)

If a border patrol officer determines that you are intending to file for AOS when you re-enter the USA on your F-1 (a clue might be the fact you are with your new American wife), then you will face deportation.

The fact is that F-1 is a non-immigrant visa, if you get married and return to the USA with the intention to file AOS, you are violating that visa. If you wish to immigrate to the USA you have 2 legal options:

1. Don't leave and file AOS.

2. Leave and file for a K-3 visa. This can take a long time.

My advice, stay in the USA until you have your Green Card. Hawai'i is wonderful, consider honeymooning there because its inside of the USA and you don't even need a passport to go there. That way you avoid any issues with visas.

I guess I'm out of luck then because I didn't realize it would be an issue to re-enter the country.

Honeymoon has been set for quite some time now and is not really possible to change.
