N-400 August 2015 Filers

Hey guys and gals, just so everybody knows: there is no FBI Name Check on N-400 apps.

This is done when you apply for green card or travel document, but not when you apply for N-400.

In fact N-400 has total of 4 checks (unless USCIS decides to do more), and those are:

CBP TECS

DCII

DD214

DOJ FBI FIngerprint (not a name check)

CBP TECS is to check your border crossing records. DOJ FBI is self evident. I am not sure what DDII and DD214 checks are , but I think both are Defence Department related.

This only reinforces my earlier assumption that getting your interview notice late may have nothing to do with name check or real security concern.

Somehting as trivial as your FB being rejected by FBI (for poor quality) can delay your application for months, because once your app falls off conveyor and down through the cracks it's really like falling off the airplane over the Ocean.

Also, FBI , for all the blame it gets on delays, is actually very efficient organisation in comparison to USCIS,and I believe if N-400 were entirely handled by FBI there would less delays in Naturalization process.

Almost 2 months after my FP I have no change on my app status. Online case status still says "On XX XX XXXX we received your application for N-400....", not a single LUD since biometrics.

I am not one of those passive immigrants from cultures where people are used to perceive bureaucrats as Olympian Gods existing to have fun watching our misery while one humbly bows down to them in hopes of mercy. For all practical purposes, inside my head, I am American, and I look at government as entity which is there to serve and to protect us, not to randomly bully, intimidate and cause undue hardship to innocent people. I would take USCIS to Federal Court and sue it in no time, if I had a legal ground to do so. But, I guess they have to screw it really bad ,may be not send me an interview notice for the 6 months to a year after the cut off date their website reports as the date when the last case was processed by USCIS (or at least 15-18 months from now in Baltimore district). So, this means there is not much if anything I can do except uselessly getting myself frustrated dealing with an organisation which is less responsive to inquiry than a monumental stone wall.

I suggest those of you who visit this thread and are in similar situation like me share your experiences (almost two months after FP with no "in line to schedule interview", while almost everyone who had biometrics after had their status change, with some already scheduled or already having gone to interview).

But I may stand corrected. I did not read the whole booklet, only a portion where it describes IO processing applications and Appendix B.

Upon closer look, it appears to be a manual for overseas operations.

However, it still gives a good glimpse at what security checks your N-400 can go through and how it's actually done by USCIS (there is a lot of mention of manual entry of information by USCIS, about method of response of agencies, by email and etc. And "manual entry" always equals to an increase of a chance someone somewhere will screw it. It's a human factor).

I seriously doubt FBI name check is a culprit and to blame for the delay in majority of cases that fall through the cracks. As I wrote earlier, it's efficient agency. It usually responds to USCIS within 2 days , even when USCIS keeps your app pending for 10 months and people think it's name check related. Some other variables are at play, and we will never know precisely what since USCIS effectively gets full immunity from accountability under the pretext of security needs. And those in charge of oversight at Congress usually usually grill and beat down DHS heads for processing cases too fast and efficiently.

Remember just few years ago USCIS made a serious attempt to bring all case processing under the uniform timeline (under 5 months)? You know, there actually was a period of time when they made an enormous leap forward and at some point it seemed USCIS would be processing all of the applications in weeks. Then backlogs, delays and lags started all over. In between I accidentally watched C-SPAN, and you should have seen how much ire and anger some Congressmen had because DHS wasn't sufficiently delaying processing of the apps.

I looked it up, both checks are for former military service personnel. You basically fill out I-426 and give USCIS permission to search DoD records. The check is not applicable to those who never served in US military. Besides, the link to guide I have posted appears to be for overseas operations. Sorry for all the confucsion.

I don't know if it's the same in this context, but the DD214 is a military discharge - since one of the paths to citizenship is by serving, it's the proof that you served.

My case still shows "Case was received On August 6, 2015, we received your Form N-400, Application for Naturalization". We both did the finger prints at the same time, 5 mins apart on 9/3 and filed applications together. I have requested a name change, will that cause delay in scheduling the interview. I thought it does not matter, only Oath gets delayed because of name change. Can I check with USCIS to see what's going on with my application or Just wait ??

MyN400, I am on the same boat.

The way USCIS works is: if you go on their own website (which they haven't updated since July 31,2015), you will see that at that time (07/31/15) the last case they worked on was filed in November of 2014. They don't post most updated information, so you have only July 31,2015 report to rely upon.

If you call or schedule an InfoPass with USCIS, they will tell you that they are currently working on cases filed on November, 2014, and your case is well within the normal time-frame. If you say everyone you know of had been scheduled for interview, thy will say "each case is unique and different".

From legal stand point all you can do is wait. But, practically speaking, you can create blogs, facebook page, post on public forums and constantly update public of your ongoing case status. At very least you can help to create awareness of the issue. Internet is one of the greatest advantages and tools we have in 21 century, somehow it turned out to be one of the best means of meaningfully engaging and exercising your First Amendment rights in democratic society.

Reporting for duty; my interview letter has arrived (Notice date October 14th, but I know that isn't recorded below). Since it'll be on the 19th it's a little later into November than I truly wanted (by about a week), but beggars can't be choosers. It's certainly... a nice, early appointment for that day (groan!). I guess that means a nice Christmas-y Oath Ceremony? So there's that.

Also, updated Eaton Inside's Interview date... unless you do actually plan on having it in late 2016? Hah.

Not really a big deal, since it's all still there, and the interview address at the JFK building is also switched around, so I guess it's just the way they roll.
