A friend of mine mentioned that beginning January 3, 2007 interview letters are issued to only those who name check is cleared. I am not sure how credible this information is??. It seems this is due to the large number of cases filed against USCIS related to name checks.

I could not find anyone from this forum who recieved interview letter after January 3, 2007 and stuck in name check. Is this coincidental?

Based on my friend's account, this new process is in place for people who received interview letter after January 3. So for people who received interview letter before January 3 and had interviews after January 3, 2007 this does not apply according to him.

I have looked at various forums and still unable to find some one whose notice date on interview letter is later than January 3,2007 and got stuck in name check. Once again, the sample is small and is based off of the information posted on different forums on immigration portal site and Visa Journey. Also, since we are just in the beginning of the year, there is not substantial amount of data.

I posted similar message on Immigration Portal and found that there is one person whose interview letter has a notice date of January 3, 2007 and physically recieved interview letter on January 9. So the lawyer's account may not be true. Any one whose interview notice date is later than January 3, 2007?

maybe its not AOS interviews held after Jan 1, maybe its the notices that go out post January... I saw Stacy received her notice in November, I am not sure when the other's received their notices.

Yeah that's what the OP said. I skimmed when I shouldn't have.

I guess that could be the case.

All I know is I would rather be in our situation (been interviewed) than sit around for 4 or 5 years with NOTHING from USCIS. I sure hope they don't start that rumored policy.

well, my interview notice date was Jan. 12, and my interview is on monday 2/26. I'll let you know what happens. I sure hope you're right.

01/20/07...Interview notice received dated Jan. 12, Yay!! (Day 68)

01/30/07....EAD touched, finally!(Day 78)

02/01/07....I-485, I-130 touched. EAD card production ordered (Day 80)

02/07/07....EAD card received in mail (Day 86)

02/26/07...Interview - name check pending (Day 105)

06/21/07.... Card production ordered email...omigosh! (Day 220)

06/24/07.....Email: Notice mailed welcoming new permanent resident on 6/22

06/30/07.....Welcome notice received in snail mail

07/02/07....Email: Approval notice sent. GC received in mail!!! (232 days from filing)

just finsihed the AOS interview today. check my signature for the notice of interview date... unfortunately we ARE stuck in the FBI name check.... as the interviewer told us, everything seems good but we have a small problem... FBI namecheck has not cleared yet.... no ead as well. sigh :(

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

so i guess we're going to assume the worst. my husband might end up on FBI name check too.

i read that after the interview...the officer will ask for your EAD, AP card (if you have them)..will they still ask for the EAD card if your GC cannot be approved due to namecheck?

No.

I know of one account where they pulled the I94. I would have fought that one.

I'd like to add that just because you are being interviewed, that doesn't automatically mean namecheck incomplete. Many people get interviewed everyday and get the greencard. More so than those who get a swift transfer to CSC and no interview.

CSC transfer is NOT the norm. Everybody wants it to be because it's so marvelous. The fact of the matter is that an interview is NORMAL.

muaaaaaaah and becca, you guys have been waiting longer. i wish we all just get the darn gc already. grrr... hahahahha... im over it. theres nothing i can do right now anyways. i started having a migraine after the interview. it was really speedy. our officer would ask one question then off to another one then come back to the same question but phrased differently, then change topics then come back to another question we already answered. i think the officer was trying to trick us and see if we were lying... she even asked my husband if he will divorce me should he receive his greencard... wow... if she only knew how hard it ws to convince him to leave his life back in the philippines and move to another country where he will stay at home for about 4 months at the very least, with nothing to do but talk to dogs all day...

the thing that sucks about our case is that we did not receive and EAD card.

hi mychelle, i dont think they will take away your EAD or AP card if your stuck in the FBI name check thing. before we exited the officer's room... she said " make sure to hang on to this (some white card with a picture of some sort) since you dont have your greencard yet. cont leave the country but if you have leave the country, make sure you apply for Advanced parole." i even told her we had no news of the ead since we have applied and received the Notice that USCIS has received our application for employment authorization. she continued to say she cant help us since their office does not issue EAD cards however i can check / call the USCIS to check on our status.... i checked online and MSC is processing EAD paperwork filed Dec 8 2006. hopefully it wont take long before we receive my boytoy's ead.

sorry to hear of your situation YnaYeBa0808...at least from your timeline...it looks like he will be receiving his EAD anytime soon.

i know that lots of people going to their interviews get approved right then and there...but that could have something to do with them getting their interview appts. 6 months after their NOA1...well...the ones i've read so far.

there are a couple of people here with March interviews at Los Angeles DO...we'll find out soon enough.
