Parental Responsibility Info

I have a residency order, which is basically custody. He does have parental responsibility. We split up in 1994 when my daughter was 2. I moved to the Isle of man 6 years ago, the year I moved here, i paid for my daughter to go and spend christmas with him. Since that visit, he moved/changed his phone number and hasnt spoken to, or seen my daughter since. She was 9 then and is almost 15 now.

Was only the end of last year that I happened to get his phone number.

He has never paid any child support since we split, we were never married either.

I just have a really bad feeling about it all.

Dawn.

Considering that he doesn't pay child support AND hasn't seen your daughter for 6 years I think you MAY be able to get around this. You have a residency order already, which gives you custody. If you could go back to a solicitors and get them to write a letter outlining the fact that your child's father refuses contact, doesn't pay a penny towards upkeep AND hasn't seen her for 6 years, also adding in info about the custody arrangements, that could be enough.

However, if I was you, I'd contact the embassy with ALL of this information and see what they say. They are the only ones who can tell you what you need, none of us here can really give you a proper answer and this is the only way you will know anything for definite. We can all guess and tell you what they have told us for OUR particular circumstances but, as we all know, every case is a little different.

I can't see how you can be expected to get a letter of consent from him when you don't even know where he is AND he told you to get stuffed over the phone. Contact the Embassy again, see what they say.

You might find that if you go to your solicitor and explain that the father doesn't contribute at all to the upbringing of the child, there are grounds to issue a new court order giving you sole responsibility for the child. I haven't lloked in to this too much but would that not be sufficient to satisfy the visa requirements? I really hope this is resolved quickly for you as it does seem totally unfair that it is jeapordising the family hapiness.

Thanks :) for the bump

I rang the embassy yesterday and they confirmed i need a letter from Ex agreeing to taking my children out of the uk to live and yes it need to be witnessed by a solicitor, So guess i better write one and get it printed off for when he picks the kids up later.

and yes i agree it should be pinned as the information that you need to provide is not included in the checklist with packet 3, so does leave you wondering esp after reading some of the threads on this site about issues people have had. I would suggest a smaller article is pinned with a different topic as parental consent is different to parental responsibility so thats prolly why i didn't find this thread when searching

check out my time line and dont forget to update yours too :D

I have just spoken to the Principle Registry of the Family Division's manager. My advice to anyone considering getting a search for prental responsibility is not to phone them, they will chew your ear off with the law!!

Just an update, the price for a 'search' on parental responsibility will now set you back £40  . You cannot order it online or over the phone. I was told to post a cheque or postal order only, for £40 to 'HMCS' with a written request stating you want them to search for any parental responsibilty agreements in place and include the childs full name, date of birth and both parents full names to:

PRFD

42-49 High Holborn

London

WC1V 6NP

Just a quick mention...the manager would not stop whittling on about in English law a mother ALWAYS has parental responsibility until and unless it is over-ruled by law. There is no point searching under the mothers details for parental responsibility therefore, as it goes without saying. You must request a search under the FATHERS name as they can only have parental responsibility if it has been agreed by the courts. She warned me that occasionally mothers signatures have been forged to give parental responsibility to the father

Yes. Dawn finally got things sorted and moved to the US last year, around June, I think. (Not positive of the excat month). Last I heard, both she and her daughter were doing well. :)

Having read through this post as it touches on my own dilema, I now have a question......

I was married to my sons mother and for the last three years since the divorce the boys have resided with their mother. Notwithstanding their residence, there was no award of custody at the divorce, however it does say 'but the children reside with their mother'. My sons are now at an age where they have decided they would rather live with my US citizen wife and I, which as you can imagine I am over the moon about. Do I need to get an amendment to the court order saying that they now wish to live with me in the USA, or is a notarized letter from their mother sufficient to satisfy USCIS? I have a little time before we file as I have asked them to spend a couple of months giving the matter serious thought before we proceed. Incidentally, the boys are 11 and 14 so no longer small children.

You'll probably want to verify with an immigration attorney, or the embassy in Londonitself, selly, BUT I would think a notarized letter from the buys' mother granting permission would be sufficient. Good luck!

Many thanks, it's either that or more expense in the courts........

Such a shame we can't get this subject pinned....it is so crucial, London is woeful in giving this info out clearly from the beginning of the process and often causes people delays/last minute panics.

Just to add....I know pets are important in peoples lives, but maybe it sacrificing that pinned thread for this information would serve better for people visa journeys? Just a thought.

I agree, I have even debated requesting a more in-depth K2/AOS section on here for a while, it would be so incredibly helpful.
