Wow, how dare he!

I still haven't heard anything from my daughters father, looks like this is going to be the thing that could slow down my Visa app.

I did manage to call the Embassy in London yesterday though. Paid an extortianate amount of money, to speak to someone that couldn't even answer my question =/ All she told me was that she couldn't really help, and to wait until I get Pkt.3 and send a covering letter with it, asking about my particular circumstances /sigh.

- June 23, 2008 - Going home to my man, finally :) POE (ATL)

- 08-08-08 - Wedding :)

- 08-21-10 - 2 year Green Card received! :)

Damn....The only other thing you could do I guess is go down the route of calling the Family Court office in Holborn and asking for a printout saying that there are no custody decrees regarding your daughter and then swearing an affadavit...Problem being of course that you are in contact with him :(

I'd try calling him again and asking him if you need to send him the money, maybe if he has you money it might motivate him to actually do something.....

I am now foaming at the mouth.

After speaking to the notary, making an appointment with him, my son's dad turns up for him to notarize the letter.

Now, as some of you may know, all notaries here are also lawyers.

Anyway, when my son's dad passes over the letter I typed, the guy reads through it and tells him in his opinion, he advises him NOT TO SIGN IT because if I 'were to disappear' he had 'signed his rights away'!!

He then gives my son's dad a name and number of someone who can 'draft up a proper agreement with all neccessary terms and conditions'....

I'm like #######???????????? What TERMS AND CONDITIONS???

Number ONE, we were NOT married, so as per UK LAW I don't even NEED a damn letter!!

Number TWO, all he has agreed to is that my son can live in the States permanently!!

Number THREE, this appointment was NOT a legal consultation, the CONTENT of the letter was NONE of his damn business and NEITHER was his advice SOUGHT!!

LUCKILY my son's dad still went ahead and signed it.

Called the notary society to make an official complaint, have to call someone back on Tuesday.

It is poor form but, unfortunately, the solicitor felt he was probably only doing his job. But that's the key here, it was his job as a solicitor NOT as a Notary. I'd write/call to the Notaries Society and see what they say. Let us know how it goes?

They said the two roles are not in any way related and should be addressed seperately unless of course we had asked him to draft a letter as a solicitor and then notarise it.

Problem being that I leave in two months.

I think what I'm going to do is write an official complaint and have it lie on file....

Just got off the phone with them, they say I have grounds for an official complaint both to the Faculty Office and the Law Society.

They said the two roles are not in any way related and should be addressed seperately unless of course we had asked him to draft a letter as a solicitor and then notarise it.

Problem being that I leave in two months.

I think what I'm going to do is write an official complaint and have it lie on file....

Definitely follow up on this. Once you move you can always change your addy for the correspondence. If I was you I'd go with the recommendations and make my complaints to the Faculty Office and Law Society. Keep us posted!

As I consider you guys the experts now (prior to reading this a dodgey immigration lawyer tried to charge £250 for a letter saying I had sole parent responsibility - luckily my c**p radar alerted me!!) I just wanted to run by you what I had just agreed with the girls dad and my plan to cover all the bases:

He has agreed to write a letter stating that he is aware that the children are leaving the country and gives his full permission. He will then take this to have notarised by his solicitor (which I'm paying for). Now to cover all the bases my idea was to also get proof that there are no parental responsibility documents registered as per this post and write an affidavit to this affect. Do think this is over kill? We do get along reasonably well but it is really his wife that is the problem - for some reason she doesn't like me (odd considering she is the was the "other woman") and if she can cause issues she has a tendancy to do so. That is why I wanted to ensure I have everything covered from every point!

Please let me know what you think, this bit is really worrying me and it seems impossible to get a consistent or even any answers from anywhere!

Change of name documents arrived for Emma and children

Fedex Em's paper work for I-130 to E in US - 10/05/07

E completed all his paper work - 13/05/07 (I'm impressed!)

Emma had nightmare that all her details were filled out incorrectly and actually spent 6 hours thinking it was real - 13th May !!!!!!

first hiccup - E "out" with work can't get to post office now until 21st May!!!

24th May 2007 - I-130 posted

29th May 2007 - I-130 received at 7am (somebody starts work early!!)

13th June Cheques cleared - one small step but an exciting one!

15th October NOA2 received - 145 days

Thank you, I did read the packet wording yesterday and realised it didn't ask for info that matched with my situation but thought better safe tah sorry was a good route to take.

Thank you for the notary advice I was just about to start looking up exactly what one was!! I didn't realise they were not solicitors. You learn something new everyday :)

His solicitor can't notarise the letter, you can find a notaty near your daughter's father at this link.

I went to my solicitor to get him to write a letter to both the fathers of my children notifying them of me taking the children to America to live and asking for their permission for this to go ahead.

Both fathers signed and returned the forms of consent.

Neither were notarised by anyone, but the copies i sent with I-129F were signed as certified copies of the original by my solicitor. i know i didnt have to include these in there but i just chucked everything in the pack lol

Is this enough because im seeing that some people have had the actual consent form signed by a notary, im getting slightly worried now that they gona say what i have isnt not good enough.

Packet 3 information regarding the children of couples that were unmarried is totally insufficient. They actually need/request far more than they mention in P3. This is where London lets itself down, IMO. They need to rewrite that particular part of the information form to give better details regarding this whole area.

Samwatts ~ All Notaries are Solicitors in the UK but not all Solicitors are Notaries. They can also be Barristers of Law, which is a fancy name for someone who practices law at the bar. Before you get your knickers in a twist check that your solicitor isn't one. He/she may have been and you may be worrying for nothing.

If your solicitor isn't a notary I don't think anyone here is qualified or experienced enough to give you information about whether or not a solicitor's signature is sufficient. Email the Embassy and ask them.

If your solicitor isn't a notary I don't think anyone here is qualified or experienced enough to give you information about whether or not a solicitor's signature is sufficient. Email the Embassy and ask them.

When I called the State Department, they told me I didn't need a letter that was notarised or seen by a solictor.

I rang the London Embassy as gave up on emailing (kept saying deleted without beign read) and i made quite clear i hadnt been married to the fathers of my children, and all bout the consent forms i had obtained. But they still insisted i needed to have consent forms signed by a notary that the fathers get.

Unless, he says, I had something stating that I have full custody of the children. I went to court 3 years ago concerning parental responsibility over my 2 youngest but unsure if I obtained full custody over them. I have my solicitor looking in the archives as i type, as the father of the 2 youngest can be a bit hard to get hold of and to get to agree to doing something that doesnt benefit him!!!

Hopefully i have full custody and only need to get the notarised consent form from the father of the eldest and he is close by so i know i have no problems there.

I know the rules and regulations are there for a reason but i hate the idea that someone who doesnt bother with their children can ruin your families chance of happiness!!!!
