If the USC is currently unemployed and

the non-usc is employed and earns comfortably over the poverty line and

we have been living together for over a year on 2 different visas and

we have a co-sposnor?

Do we have anything to worry about?

Nov 23...AOS Biometrics They also did EAD as I had my NOA, Sioux Falls, SD.

Consensus is yes, that the non-USC can be used for purposes of the I-864 if they make more.

I have not intentionally left any info out (I know you were not trying to accuse me) in order that I could maybe get a complete answer here is a summary of my immigrations history:

2001 - 2002 Exhange program to college in USA using F-1 Visa. Leave country while all documents CONTINUE to be valid

2002-2003 Numerous VWP visits to USA, none for more than 2 weeks.

2004 - July 2005 - in country on J1 visa, NOT subject to HRR. Start living with my girlfriend then fiance during this time

July 2005, return to england (j1 documents all still in status) and have successful K1 interview at Embassy

July 20 2005 - Enter country with K1, receive employment stamp (expires oct 2005.) Gain employment with company that provided j1 internship

January - 2006 - EAD card approved - regain employment with same company
