No one has asked the burning question!

Are the order the files processed in completely random?

I have been watching the forums for a couple of months now seems some people wait a year for an NOA2 and some just a couple of months.

There is a thread for K1 visas, with date submitted, NOA1 sent etc etc and today someone who filed after us at VSC got their NOA2.

There is nothing peculiar about our application (really!) We have been married for almost 7 years.

Our application hasn't even been touched, I just don't get it.

Funny, I thought Huskerkiev had answered that quite plainly - when he described the boxes and how they are distributed, etc. and that one adjudicator may start at the middle of the box, the other at the end.

And don't got by NOA1 dates - that will only be a lesson in futility for you. I was a November NOA1er and watched LOADS of December filers get approved way before me.

Our application hasn't even been touched, I just don't get it.

Of course it isn't random. It's roughly in the order received. But because they are physically processed by human hands that work at different speeds, and don't pop up like callers waiting for customer service - it can't be EXACTLY first come, first served. Some end up taking much longer because of problems with evidence or tangled background checks or botched processing.

VSC goes faster than CSC. Period. So be glad for that. But within each service center, there will be people ahead and behind you that will see action before you do. But it should be - notice "should" not "will" - be roughly the same.

1-22-07 DHS cashes the I-129F check

1-23-07 NOA1 Notice Date

1-26-07 NOA1 arrives in the post

4-25-07 Touched!

4-26-07 Touched again!

5-3-07 NOA2!!! Two approval emails received at 11:36am

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

5-20-07 Packet 3 mailed

5-26-07 Packet 3 received

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Well, I guessed I missed that post - there are well over 200 posts in this thread and I must admit I did not read each and every one.

welcome to VJ , it's a cool site to get and give information on , accually i think i still new too because i do not know any thing about immigration i just time to time i ask question but here they are so nice they respond thanks for every body

sir i just want to ask you a quick question , the case out of time and they say when we called them that case need more 180 days for security check , what does this mean

I wouldn't read the whole thread, either, but I thought that discussion was pretty early on in the thread. Because people DID want to know - it was a burning question that was asked.

Oh and the 'completely random' part was tongue in cheek. You guys are losing your sense of humor :)

Sorry, I missed the 'tongue in cheek' part. The question didn't read like that to me at all, particularly when you said it was a burning question we had all missed.

Why doncha PM him and find out? Although I would be a little hesitant to give immigration advice over PM, as he might.

If its not too personal, pose the question(s) here and then PM him that you've posed the questions.

Someone asked inside the thread about the divorce rates for international marriages ... in another thread here on VJ someone had pegged tham at 20%.... comapred with over 50% for regular marriages. Heck - 25% of all marriages that end in divorve do so before the time it takes to get an NOA1 :P !!!

Getting congressional help, for me at least, is easier said then done. I contacted several and got a completely different excuse every time about exactly why they couldn't help. :angry: >.< It is good to know for sure who was telling the truth (none of them) and who will be getting my vote next election (none of them!)

regarding files being misplaced. very seldo. Every time a filecahnges hands even from one officer in one cube to another in another cube , its wanded or scanned intothe system so its alwaystrackable as to who has it. The only thing that can sometimes happen is a file gets misent to the wrong place (ie the Vermont Center instead of say a district Office) butthe system will always know where it is, it just will take a few days to get it backto where its supposed to be because it has to be mailed back to its original destination etc..

So files don't get "lost" every file's location is know. Loosing a file is grounds for dismissal becaus eof the violation of the privacy act and security. Your file has too much nformation in it and each one is nottaken lightly. We treat each file as if its a persons life so to speak because it represents someone or a couple or family etc...

I ran into this thread much later than it was started, I hope I am not too late to receive a little of "insight" from Huskerkiev. I have found your posts very informative and interesting. Thank you for that.

This one particular post caught my attention!

So files don't get "lost", every file's location is known.
That is exactly what has happened to our first petition. And I still can't seem to get an answer to what has happened.

Let me briefly explain what I am talking about (and for those that have already heard me whine about this, please bear with me a little more...sorry). We filed our original petition back in July, 06. NOA1 was on July 17, 2006. It was then touched on October 31, 2006. From that point on, we waited and waited (very patiently, may I add). As time went on, and without an approval, denial or any RFE, we became more and more impatient. I tried contacting our lawyer many times only to be told to just keep being patient...it would be "anytime". Finally, in Feb. 07, I contacted USCIS and was told that our petition had been filed at the Missouri Service Center and should have been sent to the Nebraska Service Center. (A HUGE error from our lawyer!). I then filed to have it transfered to the proper place, hoping it would then be expedited since we had already been waiting for far too long. I was told that if I do not hear anything in 90 days, I could call back.

In the meantime, the lawyer's (ex-lawyer) office had contacted the USCIS laison and found out that our file was "administratively closed" back in October 06. No one seems to know exactly what this even means, but evenso, we seemed to have no other choice but to start over and file once again. We were never contacted by USCIS that it had been closed, nor was it forwarded to the proper service center. At least as far as I can tell. Even now, I can call the CIS customer service and check on the original petition that has supposedly been "administratively closed" and they will tell me that it is still pending. And when I try and explain that we were told through a laison that it had been closed and I want to be sure this is not indirectly effecting our new petition, they become very confused and really don't even know how to answer my questions. Especially when I say to them...."if it is still pending, how come you show absolutely no activity on our case since Oct. 06"?. Twice now, they have 'escalated' my call to another customer service rep, only for me to hold and hold and hold and when I finally hear a click, I then get a dial tone. It is VERY frustrating, not to mention, I am at work when I am calling and simply can not spend the entire day on the phone trying to contact someone that can tell me what happened to our original petition.

No one can seem to tell me exactly what happened to our original petition nor can they tell me where it is at. It doesn't even show 'closed' in the system. And we still have not been contacted to state anything abnormal has happened.

Now, like I said before, we have filed once again. I have a new NOA1 date of Feb. 27, 2007 and it was 'touched' on May 22, 2007. So I am very hopeful that we are close to an approval, but I certainly can not help but to be paranoid that something else will go wrong.

So tell me, I think this would certainly be grounds for a "congressional", don't you? I wrote a letter to my Congressman and he referred me to his "immigration specialist". We have written a letter to her, but unfortunately never heard back from her (as of yet).

I would just love to know if you have any suggestions of where I can go from here, besides just waiting more. After almost a year of waiting for a NOA2, I've about surpassed my limits.

01-29-07 - Found out from USCIS that my lawyer had filed at the wrong service center and nothing has been processed.

02-08-07 - Found out that our petition had been closed back in Oct. 2006. No one was ever notified of this from USCIS

02-09-07 - Began gathering paperwork once again to start all over. Started cancelling our wedding plans

02-20-07 - Filed for a K-1 visa once again

02-27-07 - NOA1

04-21-07 - Originally planned wedding date (had to cancel) :(

05-22-07 - Touched

06-01-07 - Granted a Congressional Inquiry!

06-15-07 - NVC received our approved I-129F petition (I never received an NOA2 via email or snail mail). We are just so HAPPY to finally move on!

06-25-07 - Packet 3 received (but it was rec'd by our lawyer, she has forwarded it on to my fiance in Australia)

06-28-07 - Fiance rec'd Packet 3

06-30-07 - Finally rec'd NOA2 via snail mail. It is dated June 25, same day as Packet 3 was rec'd.

07-05-07 - Mailed back form letter DSL-1076 (Applicant's Statement of Readiness to be Interviewed).

07-05-07 - Just waiting now in hopes of an interview date before APEC

07-13-07 - Received Packet 4

07-30-07 - Interview!!!! - APPROVED!

09-01-07 - Fiance arrives in the USA!

10-06-07 - Getting Married
