I wanted to post this to hopefully put everyone who is waiting there NOA1 and NOA2's mind at rest a bit.

To the best of my recollection, the denial rate for I-129F's is/was relatively low. The majority of people that apply for a I-129F will receive approval, it may take time because of the workload/backlog but you should eventually get it. You may get an RFE or two or none - it all depends, but again barring that you haven't got something illegal or very bad in your past, were honest and forthright and the petition is for a valid relationship (on both parties part) and everything is legit, you should go through at some point.

IMBRA is a whole different matter as I was not there when it took effect. So I may be eating my words at some point. but typically if you played by the rules, filed an accurate and complete petition and without any major hiccups along the way, you should be approved. So, hopefully now everyone can relax a bit.

Where the rub might come is that even though your I-129F is approved, the consulate can still nix the whole deal and deny granting the K Visa based upon thier recommendations for whatever reason they deem fit and appropriate. Again, State Dept tries to approve everyone, but some just don't make the final cut for legitimate reasons. I saw on the State Dept's website that they were posting around a 75% approval rate for K-1 Visa's. My personal opinion would be that if State was deadset on denying K Visa's, they typically wouldn't be giving the denied applicant an opportunity (in most cases) to correct the noted defiencies and reapply.

So I hope this helps everyone.

great info!

I would love to know your thoughts on the whole " affidavit of support" process, particularly in regards to the I-864. It states " you MUST supply (this ....and this) ......and " you MAY supply (this or that) yet people always seem to being RFE'd when they have supplied everything, or what was particularly asked for. Some have resubmitted exactly what they sent the first time and then been okayed.

If a petition shows that it meets the poverty level at the time of filing with evidence ,what initiates RFE's requesting further evidence, requests for co-sponsers etc??

Thanks in advance for helping a lot of confused souls :)

Then again you could always file a Congressional because those get pulled and worked right away. But you didn't hear that from me

(usually)...

Heh, I have a friend that did that. He had some serious "issues" with his application. He fortunately had contact with the office with a very well known senator (due to his job) and was able to get his problem resolved. Unfortunately, he lives in a different state than I...

Dear Kush ,

Why so many people were denied in Vietnam ? Are they racist ?

I'm filing an I-129F and worrying that my fiancee there will not pass the interview even everything is legit. The visa approved rate in Vietnam is about 50% or less now .

I heard a friend of mine has a kid there and he still couldn't bring her over here . Is there any quota of people from certain country to enter the US ?

I-129F sent and recieved by USCIS on Feb 16th, 2007-Also I fly to Vietnam to see my fiancee on today. This is the 4th times I have flied to vietnam within a year time frame. I miss her.

I've read all the recent posts and I saw something about the NSC not doing the hunny-bunnies anymore. Is that true? And should I still send my petition to Nebraska or would it go directly to California. Or do you know????

If Nebraska is where the instructions say you should mail your form to, then so do. They will forward your petition to California, or Vermont, but more likely California. Nebraska is no longer directly processing K1s.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

Welcome Husker. When I look around on the web at the amount of people (here and other places) talking about the immigration process I have realized just how many people apply in a given day, week or month. I believe there are some very dedicated people at the service centers and they have a very thankless job.

I guess my question would be is what exactly is involved in the approval process? Is it background checks or is it just making sure all the information "jives". (I highly doubt that) Just curious.

Good luck and welcome to the wait. ;)
